I despise new users that leave a negative and fail to read an auction. AHHH frustrating. I had a customer leave me a negative stating that our auction claimed the game was new and that he received an opened used game. Well DUH (as my son says) the condition was described as USED. Ebay needs to have some way to monitor and remove unfair negatives as this. How is it the fault of the seller that the buyer cannot read bold large print?

Oh this guy is hilarious. He just wrote me again and said it was not new as stated...So I again copied the condition USED - TESTED WORKING - EXCELLENT RETAIL PACKAING - DVD NOT OPENED STILL FACTORY SEALED
And kindly explained that the DVD was not opened the game was USED and was listed as such.
He then said he came up with a WONDERFUL solution...send him another game of equal value and we will call it quits...UM No?
I just don't get where these customers get off thinking they can pull all the punches!

More than likely your "new" eBayer isn't. They are quite possibly a competitor or a PowerSeller trying to lower your feedback and playing dumb in the act. No one is as "dumb" as you describe - they are playing a game with you to get something for nothing. Ignore them and give them negative factual feedback as a public service so other seller's know to cancel sales to them.

Okay, I'm confused.

The DVD was tested, so it had to be opened, therefore it is used.

How, then, can the DVD be "not opened, still factory sealed"?

Unless I'm missing something about DVDs, which could very well be, it can't be both "used/tested" and "factory sealed" at the same time.

KarenMx This is what digitalbruce was complaining about. you did not read the second post correctly. it says.

the DVD was not opened. the game was USED and was listed as such.

I agree with digitalbruce people do not read the descriptions properly first.

I have no idea what he sold--some sort of game, yes, thanks, I see that--so the only description I have is that fragment he posted in his second post.

If the "game" contains a DVD, and the "game" is opened but the DVD within is not...yes, I do see how that could be; but what has been tested if not the DVD? and how can the DVD be tested without breaking the seal on its packaging?

If the "game" is ON the DVD, and it appears from his posts that it is, I cannot comprehend how it is possible to "test" the DVD to confirm its working state without breaking the factory's seal on the packaging.

Personally, and as a credit to my reading comprehension skills and far better than average sense of logic, if I saw the quoted fragment in an item description I'd focus on the words "used" and "tested", and, knowning full well that such things cannot be "tested" after it leaves the factory without being "used", realize that I'm not bidding on a brand new, mint condition thingamajig and I most certainly would NOT leave a negative when I discovered that an item I purchased as "used" was, in fact, just that.

I've read, re-read and read again and STILL don't understand this description. Call me confused also.

It was a game and dvd package the game was used and open the dvd was still sealed. If you had seen the auction it was very clear what they were buying. Not only that but generally most of our customers are buying the game not the dvd which is why i instinctively put the game condition first.

He has now put in a dispute with Paypal...we all know how these end. He will of course get his money back and keep my product. I really hate that...it is theft with a large corporation backing. It is like a doing a bank robbery with Visa giving a go ahead! Crazy!!

Don't take me down, Bruce, but ME-N-RALPHIE are also confused...

WHAT format was the "game?" Was it a cartridge or sumptin?

As long as yer description stated the correct condition, and you have ONLINE TRACKABLE PROOF OF DELIVERY, you SHOULD win yer case with PayPal -- I had THREE disputes in the past & won all three...

Any chance you could COPY&PASTE yer item DESCRIPTION here -- twould make it easier to agree with you (or, disagree...)

I have no idea where he is getting his info. I copy and paste item basics and features. Anything stating condition or warranty is deleted. I have gone over and re gone over this auction. I have no idea what he is talking about.

It was an xbox 360 game with a seperate DVD. It was a bundle pack that was sent that way to us.

Why delete information about the condition? I think you are going to have to post the full description as listed in the auction for all here to understand.

After three days of headache...him being a total jerk...he wrote me and decided to just retract the negative and let by gones be by gones. My boss said I think he knows there isn't much ground to stand on.
