unless you have a legal signed contract that you are just an agent and not liable ,you are responsible to deliver the goods to your buyer or refund their money.
this is not a case of salesclerk working for a jewelry store,it sounds more like he is your supplier who provides drop shipping to your customer.
the ebay id you have is yours,not his,altho he is listing for you.
it sounds like a rather cosy realtionship between the two of you,he lists under your id and you have made 117 payments to him.
is there a romantic relationship ??
do you scribble all your passwords some where on a pad that your sons can read??
does he know your sons,does he ever call and talk to your or your sons??
have you talked to a lawyer??if you dont refund customer payments,you will be suspended for good by ebay and you will be prosecuted for mail fraud,not to mention a knock on the door by your local police/

117 payments are easy to rack up for one month when it's just before christmas, it was a high volume business at one point, the fact the last 6 payments i made for those invoices, he was suppose to send to me, this was the agreement, he would send it ups and i would send it from my location with tracking.
Romantic relationship?, scuse me, sorry you feel that way, never thought i'd hear that come from a poster, i never divulged my passwords to anyone, no i do not have them written down for someone to find in plain site, no he has never spoken to my sons, as a matter of fact, my children aren't even allowed on my computer, it's locked in an office, they have their own, which is monitored by ME....
Legal councel would be wonderful if i could find some., unfortunately with the amount of money i owe out retaining legal councel is out of the question, i hope someone out there can help me, and i'll continue with my struggle, con artists like this should NOT be allowed to take money and not follow through with their end of the deal, this is the attitude i would love to change, with so many people believing there's no way to catch people like this, it's no wonder they are allowed to continue on, i still can't understand how this is different from any other jewelry chain, it's a business with a license, under his name, he's sole proprietor and i'm just a worker, i do the handy work and he takes care of the rest, if this is the way all drop shippers (not sure what that means) work, there's gonna be alot more con artists running wild on internet.
I paid this man for a service, it should of been given, when it wasn't i should of been given my money back, just like any other service out there, you pay for it, you should get it, just as the customers who paid me for a service are entitled to a refund, or is it okay for me to go ahead and pull this stunt. Sorry a bit winded, wish i could do more.

i dont think you can get away saying you work for him and he is responsible unless you have a piece of contract in your hand.
lets try this-you said he listed under your ebay id.
so he must know your ebay password,and you email address tied to your ebay user id,which means he has access to your ebay file and he can correspond with ebay impersonating you.
what can he get out of your ebay file- your credit card number,your bank account number,your ss,driver license id,mailing address,telephone number,birthdate and whatever ebay has on file.
not to mention your feedback file with all your bidder email addresses.
now armed with all these info,plus whatever you passed on to him in emails and phone conversations,possibly some past bidders may pass on some info about you to him.
he may be able to impersonate you to paypal long before you know about it-if paypal asks him to fax bank account statement or driver license id,he could produce some fake ones,it is no big deal to pay for a phoney driver license in nyc for 15 dollars,may be 25 now.
you said he has 3 ware houses full of jewelry and a workshop,then he is an employer and employer can ask for credit report of potential employees.
if he does not have your password,he could use all that info gathered to get your paypal pasword,what if he said i forget my password,could you please tell me what it is?well if paypal said prove to us you are who you are,he has enough to prove he is you.
trace your steps,he may just know you too well.

it just dawn on me and i like to hear comments from you folks-some of us still pay with personal check.
right there is our name and address and phone number,some moron bank will even print our ss number there,on the bottom of the check,aint that our bank routing number and bank account number,hey aint that nice -a starter kit for some one to do something??

If your theif is way crafty, he may have gotten you to download a trojan program like back orifice 2k or a key logger. He would be able to see anything you typed as well as email and any files on your harddrive.

lol, with friends like that who needs enemies lol.
i haven't been over to check yahoo yet, i'll take a look, he's popped up on ebay Australia and was quickly taken down, he's now under another seller which i'm working on.
at the moment he's sending out emails to people with pretty disturbing info he claims is FACTS, i spoke to a New York Detective and i do believe this man is a friend of his considering he never bothered to ask for my EVIDENCE, just kept claiming the guy brought in all my invoices with proof that he shipped, i kept asking how he knew he had ALL MY INVOICES considering i hadn't sent anything yet????, tells me this isn't a criminal case.
So far this guys gone and sent one of his sellers after me, she couldn't back up her story that was full of holes, and all of a sudden she's disappeared now, he's sending out emails to folks i know full of lies and deceit, i can't believe he can get away with this.
oy vey, right now were calling this saga "As the stomach churns....ebay style".

Well he's at it again, he's now back up on ebay under two separate Ebay id's, how do i know this?, he emailed a former customer who i've been in touch with alot, told her right out what he's two new ebay ids are, which one he uses over on Yahoo now also, even gave her the phone number to call him.
we went to the site connected with one of the new id's turns out the same number he gave out is the same number from the website that is attached to the ebay id, i contacted ebay and guess what?, They claim there isn't enough proof....how can a connection with a phone number not be ENOUGH PROOF, i also went in and found his past id's on ebay under his own name and all former sellers of his, and there's a huge pattern, all the negative feedbacks on the id's state the same thing, money sent and no merchandise received, one seller was smart enough after getting a couple of negative feedbacks about unshipped goods to break the tie, lucky for her she can still sell with her head up.
I can't believe this guy is getting away with this STILL, how many buyers on ebay must he rip off before an investigation into his business and conduct take place?, i'm amazed Ebay can allow this. what's really weird is two other sellers i have dealt with in the last two years are huge sellers, they have a ton of feedback and no where is there as many complaints as this guy gets, he claims he's shipped and has the proof to back it up, but how is it that one HIGH VOLUME seller out of the tons on ebay manages to have so many packages go missing?, unless of course HE ISN"T SENDING THE PACKAGES AT ALL>>.....

Why would someone that claimed to have such a profitibale business as the jeweler have hired outside people to do his auctions ?
If he was a real legit business,couldn't someone in the company handle the ebay stuff ?
That makes no sense to me.
Paypal computers would have been able to spot if someone was using your ID and putting in 2 thousand different combinations for your password.I'm sure someone in their security department would have been allerted.
It's my belief that somehow that person got your Paypal password without hacking into Paypals system.
Do you keep your passwords written somewhere ?
Could this person have ever called your kids and pretended he was Paypal and asked to verify the password ?
Good luck collecting.Sounds like a hard lesson learned.

One thing guys-- Yes someone can hack into your Paypal account if they know what they are doing. It happens. I never leave much of a balance in my account for that reason (or the bank account it is linked to for that matter).
