Today I found 2 sellers using my image without my permission.
I sent them email:
"Please do not steal other seller's picture. It's againt's Ebay's rule. Your picture is mine"
Here's their responds:
Sellers 1:
Hello,
If there is no copyright on a picture it can be used by anyone thank you.
Sellers 2:
Can you say copyright? Not
I did not steal your picture. Anyone can get a picture off of the internet as long as it is their is no copyright on it. Guess what I have a degree in?
Can you say lawsuit?
I can't believe this people. Because of their responds, I reported them to Ebay. At first, I had no intention to report them,I just want to remind them that stealing other seller's picture is wrong.

The people who stole the images are wrong, by the way. Copyright law was changed in the late 1980s. Before that time, a copyright notice was required. It is no longer a requirement.
From the U.S. Copyright Office web site, answer to FAQ 53:
A copyright notice is an identifier placed on copies of the work to inform the world of copyright ownership. While use of a copyright notice was once required as a condition of copyright protection, it is now optional.

Maybe if you put © on the bottom of the pictures it will chase them away. But if they care, they would probably just cut it off.

WhenI used to run a site I had people who used myimages i my autions. I could always tell by doing a usage report. When this happened I would replace the image they were using with a graphic stating
"This seller has stolen this image from ww.xxx.com
If you would like to purchase this item
Please feel free to visit our webite."
I gained quite a few repeat buyers this way. : )

It is definitely against eBays rules.
Maybe I can shed some light on this subject as it has happened to me lately. Following is a URL to eBays guidlines and rules about copying images or using descriptions.

Now write them and give them this url and if they don't remove your pictures turn them in.

It's gotten bad enough that I've added verbiage about all pictures and text descriptions being copyrighted to the end of my auctions. Plus I've had to start putting my name in the pictures, usually across whatever I'm selling. I wouldn't mind if they stole my closed auctions but to put them up at the same time as mine...Sheesh.

What she failed to mention is that it's at the expense of other sellers.

I just wrote her an email-"I see you have a picture of a sunset on your auction,whats that got to do with selling a watch?? Who's going to spend all that money,and not see a picture of the watch, thats the dumbest thing I've ever seen"... I wonder what her response is going be lol

By the way ebay ended auction from seller# and today I received email from her:
"Can you prove that this was you picture? Maybe You stole it! Do you have a copyright on it? O by the way thank you for saving me some money"
This seller has a really bad attitude.

anandasmom, how do you process your photos? Most picture software lets you add captions. You could add a copyright notice- across the middle of each photo, perhaps. Clipping the edge of the item in it, so that for someone ignorant it would be tough to get rid of the words from a stolen jpeg. OR- add a "signature" pattern to the fabric or whatever you use as a background. Use the same background every time.
And send that latest email to safeharbor, which I'm sure you already did! It's pretty much an admission.

shop4shoes, yes she's selling jewelry too and she has good feedback but she doesn't want to spend some money to get a camera and spend time to take pictures.

i hate to sound stupid, but how do i put a name or mark on my pictures? I have Picture It software, Fujifilm software and Irfanview. how do I do this?

I don't have an editing system like yours but this is how mine works.
When you are editing your pictures, croping etc is there anything in that menu that has an alphabet on it? If so click that and you should get a drop down box to write what you want on your picture. After you have written what you want click ok. Besure you select the size script you would like maybe about 14 or so then hit okay and your dropdown box will go away and your writing will show up on your image, that is if you have a different color script than the background. If your background is black then select white to write with. Then to end it just click the box with the arrow in it.

I'm with you up there! I use acrobat? and have no idea how to "stamp" my photos!
I have only been with AW for a few weeks and have learned more in this time than with 2000+ auctions on ebay! So a big THANKS to everyone for their help!

Libra, in my Fujifilm I can't find an alphabet anything. The Picture It program, I am dumb as mud on it still.

I need some more information. What is the name of your photoediting system? Does it have an instruction manuel? Is there a web address for you to go to for help?
I searched picture it but many items came up. So give me the exact name and I will search again.

One more thing. If you can't figure it out how to do that, then when you take your images put your identifying mark on or by your object. But there has to be a way to mark your pictures.

rarriffle, I have Picture It and in Workbench it has Text. If you have your image selected you can click on Text and then Add Text. You can also edit Text, etc.
I also have IrfanView but when I have my image on the screen and click Edit the "Insert text" isn't clickable. Hmmm... I think I am having a blonde day.
Perhaps if tomwiii or twinsoft show up they can tell us about that because I think they are more familiar with it.

Okay, I figured it out in IrfanView. You have to drag your left mouse button where you want your text to be. Then you click Edit and insert text.
Also in IrfanView when you insert your text you can click "append copyright" and you get the © symbol after it.
IrfanView is a free download for those who may wish to use it.

kiara-I have picture it! also--I love it.What edition do you have? I have the 2001 edition-I know they have some digital edition out now-do you have it or heard anything about it?

I learned a lot from this thread as usual, thanks to the very informed helpful people here!
I guess this marking our pictures can save a lot of headaches, make the stealing son of a guns look harder for images to steal and they may even have to break down and buy a camera off ebay hopefully from one of you.

I like it when they say "I didn't want to get my equipment out for only a few auctions".
Do they think I like taking images and editing them. That is what takes me the time and I would rather not have someone else capitalize on that. Lazy sellers that's all they are....
