I have been listing things on ebay for about 1.5 years now and i have always trusted ebay and paypal. Well i bought a gateway computer for me just because i needed a new one on ebay,the transaction went well all things worked out and paypal was great.I went on vacation on a monday and got back the next tuesday and i checked my email expecting to have quite a few,I noticed i had a few from the person i had bought the computer from and from a buyer of some of my merchandise.well i opened them and i read that i was being sued for $5000 because paypal had done a chargeback because they had limited my account for an illegal reason.i am now going to court witht his person and we are about to sue paypal because they illegally charged his bank account and he was unable to pay his bills so he got kicked out of his appartment.all of this would not have happened if paypal had not acted illegally not emailed us telling us we would see the charges soon.But the part that angers me the most is paypal told us they would be keeping the money which was $850 which is'nt right and i dont think it is legal . they told us that paypal reserves the right to keep all chargeback money they get so that means that they do nto give it back to the people who payed me with it ,they do not give it back to me,and they do not give it back to the seller .so i payed him double because of this and we are now seeking lawyers to sue paypal for $12,500 for damages they caused him and me.and when we called the technical support line they said it isnt our fault if we sent it to the wrong email that is your fault for having an email that is confusing to the computer.anyways my point is paypal sucks and this is another case where they were unjunst in doing buisness and we hope they will change their ways and become the company they once were.

Go for it. If what you are saying is true, PayPal acted illegally on more than one point. They don't have the right to keep the chargeback money. I have no idea where they get that. They can keep a REASONABLE fee, but not all the money. What then would be the point of a chargeback? Also, the agreement clearly states that they cannot go into your personal bank account.

Notice Date: January 8, 2004
Effective Date: January 8, 2004
Updated main User Agreement and Payments Policy to remove provision which permitted debiting of bank accounts to recover money owed to PayPal.

They've violated their own User Agreement! Sue the bejezus out of them! They need to be put in their place. I won't use PayPal for high end items. It's check or money order for those. Not worth the risk!

I am also having trouble with PayPal. I can't seem to change my email address to go along with my auctions. They (paypal) say it is eBay but I get notices from eBay and not paypal. Lucky I kept my old email address until this gets taken care of.

I had the same problem. It's fixed now, but I'm not sure how. I had to keep the old address there for a while, I do remember that. I also made sure the new email address was my primary one. It's stinks!

i have read your post several times and it is confusing as to what happens??
you bot a gateway computer from an ebay seller.
then what happens??
who filed chargeback??
whose account was restricted??
whose bank account was accessed by paypal??
who sent email to wrong email address??
who is suing whom and being sued by whom??
Did paypal restrict your account and for what reason??
By the way,as the prior post said,paypal can no longer access member bank account,but it can restrict the fund in his paypal account.
May be we can help you if you tell us what is really going on.

The OP has given NO details, other than that PayPal is mean & does illegal nasties to poor innocents as part of it program of going out of business!

The interesting thing is that the only reason that PayPal would debit the sellers account is if
1) Buyer filed for a chargeback
or
2) Buy used fraudlently accessed funds (stolen credit card, etc)


So - who was acting illegally again?

Hi.

I totally agree. Hang 'em from the highest yard-arm, Mate!!!!!

Ebay owns PayPal and they get us coming and going. I thinks its major a rip. First you pay eBay fees to list and then a Final Value Fee for the sale and then they turn around and charge you again to collect your money. HIGHWAY FREAKIN ROBBERY!!!!!!!!!

I want in on this suit as support to you!!!!! Add me to your support group.

So anyway....if you paid with a debit card or credit card (as you really should for these very reasons)you should go straight to your card issuer, i.e. the bank that you have he card with. They will immediatley credit your bank account with the funds and then they will go after who ever it is. Lets see PayPal argue with a slew of banks & Credit Unions. They (your bank)will recoup their money that way. Its part of any and all credit unions and banks whose members use their cards for purchases on or offline. USE THEIR (your bank)PROTECTION SERVICES!!!!!!!

I hope this sheds a little light on the subject of chargebacks and just plain being ripped by a seller or buyer and what recourse you may have. Thats why I use a seperate card account for any online transactions. I have mass protection from my bank. I don't use Cashiers checks nor MO's for paying for items. I will use PayPal to pay them but it uses that special account I have with my bank. When all else fails....go to your bank...FAST!!!!!

I hate to rain on your parade,but if you visit this board often,you will hear from some bidders who filed chargeback with their cc issuer and were told since paypal is a third party and they paid the third party,the cc issuer does not get involved.
what that means is that you will have to take it up with paypal for any grievances-which means paypal buyer protection 30 days policy.
Of course not all cc issuers are like that

You brought up a good point. Also remember that using your debit card is NOT the same as using your credit card. You are not afforded the same protection. Correct me if I'm wrong, but isn't using a debit card the same as a checking account withdrawal? A lot of people assume that because their debit card has the MC logo on it, it's the same thing. I run into that a lot where I work.

i am not clear on this debit card issue.
Didn't Walmarts etc sue MC/VISA ??When customer use their debit card in store,altho the money is debited from their bank account,the credit card issuer is still charging the merchant a discount fee??
I know in some stores,the machine will ask you to say if your card is a debit or a credit card??
When i use my Paypal debit card,i will always use it as a credit card so Paypal earns a discount fee and rebate me 1 1/2%.
I also know costco would not take my bank debit card which has a MC/VISA LOGO on it,they said they will have to pay the discount fee.

OOOOOOOOOOO, IF,,,,,,IF,,,,,,,,,IF ,,,,,,,I ONLY knew how to bring and e mail verbatim in here I would.......But,,,,,,,anyway,,,,,paypal says call back in ,,,,,get this,,,,75 days! yup 75 days to SEE,,,,,,,how this dispute is going. That was AFTER 30 days of OTHER BS. guys buys my "item" uses it,,,,,complains about it AFTER he wore it out(In a week)and THEN files with PAYPAY. I never got my "item" back. He has it and I,,,,,,,,have nothing! Plus,,,,,,paypay TOOK the money from future sales as they came in to the amount of the price of the item. That is ONE e mail I will NOT delete till whenever 75 days arrives. 105 days total. I have NOTHING! The jerk was a 0 feedback buyer.

Anyway,,,,,,,Have a GREAT Holiday weekend.

Paypal and e bay are behind us sellers 100%.

I don't know about the discount fees. I do know that if I use a debit as a debit, I get charged a fee, but if I use it as a credit card there's no fee. The bank tells customers that a debit card is not a credit card.

The Walmart things burns me. I don't shop there any more. They won't accept them as credit cards so YOU have the pay the fee. I figure they already make enough money off people (and their unsuspecting employees), so why would I pay a fee to shop there?

I believe if you have a bank debit card and you use it at your bank ATM machine,there is no fee.
But if you use it elsewhere,your bank has to pay a fee ,so it is passing that fee back to you.
Costco,Sam,Walmart etc work on thin margin and relie on volume,so such fee will eat into their margin,i dont blame them for not accepting debit card with MC/VISA logo as they are treated as credit cards.
What i dont understand is the post office,they take credit cards.
In some countries,stamps are just as good as cash,so it is like you buy 100 dollars worth of stamps and the post office only get back 98-99 dollars.

may be you can ask your bank or walmart,may be the fee is minimal and they just pay it.
does your bank card has a MC/VISA LOGO on it??

Yes, my debit card is a MasterCard with the logo on it. No fees have ever been charged to me ever and the WalMart card machine has a credit card or debit box to check.
