I shouldn't need to ask advice on something like this 'cause I've been selling for a while, but bear with me please. Each transaction is unique, has it's own problems, etc...
Sept 7th I had an auction close for over 400.00. Bidder says Cashier's check was mailed on the 11th. Never shows up in my mail box. He says if it doesn't show by the 19th, he will send another Priority or Next Day, whatever would work best. I emailed him on the 19th saying it would be OK to proceed with the new check since the original hadn't showed yet, etc. He never bothered writing back so I pulled his contact info on about the 20th and called, talked to his wife I assume (he was out of town evidently). She assured me via email on the 21st that he would call later that day and without question still wants the item. I still haven't heard from them.
I think I've done my part with this bidder. How much longer do I have to give him? It's been 16 days now. He has zero feedback. I think if I don't get payment by the 28th (3 weeks) or some kind of solid communication he's going to have a -1 on the 29th.
No, I did not have a time limit on payments in my TOS on this auction. Because of a lot of recent problems I have added a 14 day limit.

What I find a little odd is the buyer's nonchalance regarding his missing cashier's check. If I had purchased one for $400, you can bet your bippy I'd be down at the bank to see if it had been cashed yet.
I think your plan of waiting until the 28th is more than fair to the buyer. GOOD LUCK!

I'm with you on that and likely he never mailed a check at all, but once I negged a buyer because I was sure he was lying about sending a check. Afterall it had been weeks and I still didn't have payment. Guess what? The check showed up almost 3 months to the day after he said he mailed it. Postmarked the day he said he mailed it, 3 months earlier. Of course that was from Brazil, this is California.
I really felt bad for the buyer on that deal. I added a retraction comment to his feedback, sent his money back and sent him a free item. Not much more I could have done for him I suppose.

Oh geez I would give the new guy a break I mean Right after his wife talked to you and assured by email he would contact you.
She went into labor and rushed off to the hospital, the poor guy got home found the note change his clothes in a hurry left his clothes on the bedroom floor in his rush with all his money and credit card still in the pocket and rush off to the hospital with his wife.
While he was there he received a visit from the police as it turns out in all this rush a candle was left burning in the bedroom causeing a fire that burnt up his pants& money and melted his credit cards.
he did call the bank to get new cards he has the new cards and has went to get the new check for you but when he got to the bank it was being robbed and so no luck getting a cashiers check .
the fire didnt get to his computer and it is all working but as it turned out the night after the fire there was a big thunder storm and the only Local ISP in there town was wiped out with lighting and hasnt been able to find a temp free service with a local number so he hasnt yet been able to email to let you know.
He was more then likely thinking of sending you a picture of there new baby to prove some of this but wouldnt you know it his email program crashed and deleted all his saved email and your address is now lost too.
wow imagine starting on ebay with a -1 I would be fighting my evil and good side over leaveing this feed back for sure.

Probably been plenty of people start with a -1. Some of them get their act together and go on to be good ebayers. Some just go.
I did an off ebay transaction recently with a -1 guy that I was hesitant to deal with. He turned out to be a great guy. Sent the money fast.

I know this will tick AW readers off, but I use a seven day deadline. I have most of my money in about ten days or less... and very few deadbeats. The reasoning is strictly psychology. The longer the deadline, the longer past the deadline they will go.

Mballai..I don't mention ANY time limit and most of my customers have paid within 7 days after the end of the auction.
doesn't appear, to me, that it is neccessary to put conditions like time limits in the TOS since most people pay almost immediately after the auction anyway.

tex - I'm with you on this one. If I had a cheque for that much go missing, I would be just a bit anxious to find out what happened to it.
mballai - you give your buyers 7 days then accept payment if it arrives in 10 days??? Shame on you for not following your own ridiculous TOS

Starvin', my have you been appointed the OAS private eye? This might of been expected as when scoundrels are being soundly defeated with factual arguments, they invariably resort to attempting to discredit their critics by digging up dirt.
