Rumaging again thru my old stuff, I found an old Transformer's: Beat Wars Tape.
From what I've been able to piece together from my old memory, I got the tape as a store incentive at a Toy Store (Someone noted later Kay Bee did a promo like that several years back); I bought this figure and that figure to get the tape.
The tape contains two episodes. It came in a White sleeved jacket, and has the sticker on the tape with the Beast War's Logo, and the Copyright info. No markings to indicate no resale or whatnot.
I posted this query on several Transformer Sites, and got mixed responses. Some recall the story I told about it being a store incentive (one named the retailer) and told me to go for it, a few balked, one claimed I had a illegal production tape (whatever the heck that means), and a few advised me either sell it privately, or just take all your old Transformer Toys and slip it in with the items.
Please advise. A search on eBay turns up nothing on my item.

Why not just give it a shot? If you aren't concerned what it will fetch, put a low starting bid and make sure you don't lose anythig on shipping. Also, use a 10 day auction in case there isn't much interest.

Why not write safeharbor and ask them? If you include a picture of any markings and let them decide? If you don't want to take the chance of getting in trouble that seems the safest way to me. If they say it is ok, keep a copy of the email ok'ing it's sale as your insurance policy?

CS- Did you mean to call the tape "Transformer Beast Wars" as opposed to what you have typed "Transformer Beat Wars"? There may be a difference, unless the tape came with go-go boots or something, I wouldn't see any relationship to Transformers, hence, the bulk! But, I would say list this item as a toy premium/giveaway item. I can't see why this would be any less of a considered pop culture item than those Buster Brown comic giveaways when we bought those buckle down shoes a few decades ago...
List it as well as the condition and original packaging and maybe with the details of how you obtained it...have fun either way. (Just leave the go go boot's in the closet).. : )
