In cases where a seller, for various reasons, has decided they do not want to extend their TOS to a non-responsive bidder, someone who has not answered seller's emails, promised payment, then did not contact seller as to when payment would be forthcoming, yada, yada. If I contact bidder after 7 or 10 day time period has passed, and tell them the transaction is void because payment has not arrived and no communications as to its status, how can I still apply for my NPB fee, since the bidder will also receive the same email and it will ask the bidder to please work things out with the seller, and send payment, yada, yada. In a situation like that, the bidder can go back to eBay and say, well, I wanted to send payment, but seller voided the transaction. But, since the bidder did not pay within my TOS timeframe, can I still collect on my NPB w/o bidder getting the NPB email from eBay? I would not mind extending TOS for a bidder who was upfront with me or communicative, but when I am dealing with an irresponsible bidder, who has been paying off other auctions after mine closed, I am not in any frame of mind to extend my TOS to that person.

When you file a NPB alert, it asks that you wait 10 days to work things out with the buyer/seller. HOWEVER.. it also states that because so much time has gone by, the seller is no longer obligated to sell the item to the high bidder. So it's your choice.

You and the bidder will both get that same email - there is no way to get around that part. If the bidder then wants to work it out and you don't want to, save that email from ebay and show them where it says that you are no longer obligated to sell to the high bidder.

Chances are, if you don't hear from the high bidder within 48 hours after filing the NPB alert, you never will.

I understand what you are saying, but sometimes for reasons that we don't expect to happen the high bidder may have had a family problem that keeps them from contacting you, If you were to wait a little longer then 10 days like maybe 15days that would seem like enough time for what ever happen to be cleared up a little. Also check and make sure that the person is really on active on ebay because if you see they are active, don't wait longer then 10 days. Because then that means they just don't want to ans. your emails. Sometimes we
have to be a little more understanding of other peoples problems,
You waited 10 days whats a few more, its all the same.

I understand what you're saying, Marilyn, but if you'll note in my initial post, after reviewing the seller's feedback, the seller has been paying off auctions that ended after mine did, so it looks like s/he is intentionally stalling where my auction is concerned.

I have a buyer just like this, mine has got a 14 rating no neg and 26 bid retractions, they are still bidding on other items and paying but I have not even recieved a email from them yet, I sent 3 from my reg. email, I emailed to a friend, and I used a different email and still no response. I tried to file for the FVF but ebay says that it is not my auction I do not know what to do now.

I had a buyer like this recently. Had purchased a number of things & had paid the other sellers but seemingly wouldn't answer my emails. But he had perfect feedback, all glowing over his quick payment.

I tried the "mail this to a friend", I used "high priority"..finally in desparation, I went ahead & used the NPB on the 15th day.

Even a couple of days went by before he contacted me & swore he hadn't received any of the emails. Now why he hadn't contacted me in all that time is a mystery but he paid promptly that day w/PayPal, so I guess it happens. He was very apologetic & said he rechecked his email twice to make sure he hadn't overlooked it.

If he hadn't already suggested it, I was going to request payment via PayPal only. When they've kept me dangling for this long w/o a really good reason, I only give them the option of on-line payment...no way I'm going to sit around another 2 weeks waiting for them to mail a check.

With the recent rash of college/high school kiddies bidding out their collective arses as some kind of game, we, the sellers have been subjected to huge losses due to failure to pay, ignoring e-mails, all the usual insults of selling. I've had to resort to placing a disclaimer in my TOS that states I reserve the right to reject bids from buyers with negative feedback and no longer accept checks or money orders. I'm tired of waiting 10 days here and 7 days there and eventually getting nothing in return. Adding insult to loss, you don't get your listing fee back either, just a FVF. Where have all the buyers gone??? I haven't had a bid from a buyer with over 200 fb in ages.

Well, if you no longer accept cheques or money orders, that could explain part of your problem

Some people cannot/will not use the other options (PayPal and that ilk, or send cash). What's left for their payment options on your listings?

I respectfully suggest YOU have driven the buyers away from YOUR auctions ...

Your right, You should leave neg. feedback in that case, (if the person is still active and never ans. your emails.)
I just received a email from a buyer who placed a bid on my auction and just ans. me with her mailing address. After that I heard nothing for over a month. So I went and left neg. feedback. Today she emailed me asked if I still have the item, because she had a family problem for 5 weeks. She said if you leave me Neg. feedback I would understand.
I told her I already left Neg. feedback and I really felt sorry that I did that. This situation has opened my eyes to the fact of not being so fast to leave neg. (even if 5 weeks passed)
From Now On I will track there activity on ebay, and if I see no activity I will not leave Neg. Feedback, but if there is activity I will leave Neg. Feedback after 30 days, Thats MY new policy.......
