Oh boy am I ever pissed. Sometimes I wish that I wouldn't have to deal with children buyers, but my items prevent me to of doing so.
Today I got my first crackhead neg. And, unfortunatly, my first negative. This was NOT a retalitory negative either! It was due to a disgruntled buyer who did NOT read my TOS.
Sellers, this is insane. We all know that buyers don't read our TOS', but all the way to the point to where we receive A NEGATIVE FEEDBACK because the buyer did not read the TOS?
The negative was not about shipping prices (mine is at a cool 4 dollars). Mine is not about lackluster poor service (which I am not). It is so to the point to question the integrity of the item, which the buyer was horrible mistaken.
In the case of action that buyers would mistake this item for this specific something else, I stated it MANY TIMES in my TOS.
My TOS isn't really a terms of service/sales thing, it is a large amount of text explaining generic history and information on my items that apply to all of them. Therefore in doing so, it keeps my auctions clean and organized, but to the buyers who don't read the TOS, left without proper and needed knowledge.
The buyer had e-mailed me... 5 days ago, saying the item was this and was supposed to be that. On top of the that, the buyer said the item did not work, and said he/she had contacted eBay about my fraud.
I said a very cool response explaining all possible reasons the item may not work, and anything that they could do to fix it at their own home for no money. In any case, I offered a full refund upon item being sent back and after item examination (the item should work, shipping damage is nonexistant for this case). All this return policy is stated in my TOS, and from the e-mail, I already knew the buyer didn't read the TOS and I promptly yelled "#*!@!".
The response also told the buyer to please contact me before contacting eBay (although they will not follow up for them, they never for me!). Also stated was to PLEASE contact me again to resolve any unmentioned problems.
What do I get? 4 days of silence and a neg this morning. Ugh. To state the unobvious, this is a heavy-duty buyer, but always comes through with payment. I will do research on the items she bought and the TOS' on those auctions to see if he/she had also underminded the seller.
I am not asking for sympathy, but only for a calling. This is a problem, receiving negative feedbacks due to buyers not reading the TOS. I have left a very cool response to her negative, though.

I am afraid the buyer might do a money drop on the money order...
Can the cancellation of the money order still happen AFTER the money order has been cashed?
Also I am going to be making a new account, auction format, and TOS this weekend. I have had horrible stalkers this past month and I just cannot stand it anymore.

I am sure you feel better now but the rest of us have no idea what is going on because your
whole statement is so careful to say nothing specific as to what kind of item you sell or why it is so hard to damage shipping or why it needs such a big generic explaination that
we can make no real judgements are add any suggestions for you.
It gave me pause to consider if your TOS are
as elusive it is no wonder the buyer is not informed.

macandjan - I took special care to make my post generic enough so you cannot find my items (and therefore giving myself free advertising). I believe doing so is agaisnt AuctionWatch rules.
I am suprised to think that you would think my TOS is elusive. It is 5 paragraphs, each with 6 lines! COME ON, it even has a whole different color base then the item description, with BOLD LARGE TEXT saying Terms of Sale, please read before bidding!
I guess I forgot to mention that.

If your terms afe 30 line long, 5 paragraphs each with 6 lines, it seems to me you areasking for problems.......why so long?.......i would love to read them, certainly you could shorten them......will you post a copy of them here?......never sweat a neg, justified or not...its all part of the game..

It's pretty unclear, to be honest, what they negged you for - could you perhaps post just the text of that feedback?
As for advertising your auctions, AW - nor the people who read here - will think you are advertising if you post your TOS and ask for a critique of it. It's possible that you would get suggestions that would help prevent future negs due to misunderstandings.

just one suggestion.
In your tos,
First you say, "These are not from an official set and are not in an official set." (That is very clear)
But then you add, "These are as real as they get. "
If you omit the sentence, "These are as real as they get.", you have a clearer statement.
"As real as they get" to some people means a genuine article.
It might help to move the first sentence, "These are not from an official set and are not in an official set"
to the description area rather than bury it in all the tos stuff.
I wonder how it would work out to eliminate
the long tos and just state shipping charge
and a couple of other items that are important to you.

I must make that new eBay account with the new TOS - today!
"As real as they get"... I guess that could be misleading.
[edit] When I said children buyers, I mean young teens (10-15) buy my items. I have dealt with that age range for 4 years now, and man, are they not the best group of people! [/edit]

I didn't know that! I don't know if the person is a minor, it is just a sixth sense. I believe I haven't cashed the money order yet (boy am I setting myself up for a bad MO), I could check the names of the payer on the MO and the name registered for the eBay account, that is, when you request user information, you get their phone number and their name.
And just when I thought eBay's rules were a bunch of ho-ha.
