I did it for the first time in over 300 transactions. I took a bad check and sent the guy his item. I had nothing into the item but the shipping and the bad check fee cost me $15. I trusted him as his check number was over 3000 and it was a reputable credit union. Now I have to collect. The check has his address, phone number and AR driver license number. I have called him once and he said he'd send me the money plus fees but nothing in over a week. Any suggestions? I will call him again tonight then send a letter. I can do other things but they are a bit nasty. I really don't care about the money but I hate that someone would do this to me, an individual. I can't really write it off as a loss. But if I remember my tax form perhaps I can write it off and at least reduce my tax bill and get back 20% to cut my loss (this would be about $10). Any suggestions? I'd even give up the $40 face amount to someone in Fayetteville AR if they could get the mmoney from this deadbeat.

Seems people don't read things like this unless they see responses there already. I have the name of a private investigator in the area where the offender lives ahs anyone ever offered the face amount of a check to someone just to be sure the perp pays? I'm out a small amount on this but like I said it is my own money here. Thanks

I'd call his bank right away & see if there's money in his account. Friday was payday for a lot of people. If there's a decent amount of money in the account, you can take a chance on cashing it again before other checks he's written lately have cleared. (Or wait until the 15th, when it's less likely you'll be competing with a rent or mortgage check.)

I've also heard good things about http://www.madagency.com as a collection agency.

Here in Virginia, we have a service that specializes in this kind of thing. They do not charge you for the service, but rather collect their fee's from the writer of the check. Maybe Arkansas has something similar.

I have a bad check too. I am planning on calling the check writer's bank (Fleet). The branch is not indicated on the check. Will I be able to verify funds by calling any Fleet branch?

Claim income on your tax return, minus the bad debt (a net zero) and sent the guy a 1099. At least he will have to pay the IRS.

Actually a good idea if over 600 bucks, but don't think it will help you here, I don't think you can even do a 1099 for under $600

THE GUY EMAILED BE AFTER i SENT HIM AN EMAIL monday and claimed that his aunt in trinidad died so he was away for the funeral. He had given his wife instructions to send me the money but the item he bought from me was bad according to his mechanic. So she waited til he got home. I told him that a used auto part is a chance and I was unsure of its condition. I would refund his purchase price if he'd send me the money for the check and the part back so I could verify that it was the same one I sent him. I might have a better dialogue with the gentleman had he not given me a bad check in the first place. I have given him another week then anyone that can get the money from him can have it all!!

spuddy98 ~ I live in AR, not close enough to Fayetteville to help you.. but enough to give you some advice.

Bounced checks are a *serious* matter here in AR. The courts don't take it lightly. If this person, does not pay up.. then you need to contact the City Prosecuter in Fayetteville to see what you need to do. You can find information, on how to contact him (not sure if I can post that contact information here.. so here's the webpage):

They should be able to give you instructions as to what to do .. how to collect.. etc.
