I recently bought something (I've been buying for Christmas), and what I bought was great, except one of the pieces (set of 8 items) was broken. I didn't pay for insurance since it was a small ticket item (less than $10 INCLUDING shipping.) However, looking through the box, I realized the item was broken BEFORE shipping because the piece that was broken off was NOT in the box, and the way it was packed it would have had to have been in there had it broken during shipment. I e-mailed the seller on Thursday and said that while I was very happy with the item in general I was disapointed to see one piece was broken, and it had to have been broken BEFORE shipping as the other part was not in the box. I've not heard back. Did I do the right thing? Am I wrong in thinking I should be compensated in some small way (it was a small ticket item). If it had been broken in shipment it would have been different. I hope the seller doesn't think that since I didn't purchace insurance that they arent' responsible for something that was broken before it it was shipped. Had it been broken in shipping, I would have assumed responsibility, but since it was broken BEFORE. . . Opinions?

I think I would feel just as you do, if I could not find the broken piece in the package. What kind of feedback does the seller have? Does it appear that s/he has done stuff like this before?

Are you 100% absolutely sure that it was broken before ? Was the box completely 100% sealed all the way around every single opening or slit ? Can you be 100% positive that the piece didn't fall out when you opened the package ?
If you say yes to all of the above then what you did is reasonable. If not, you jumped the gun.

It was in a box with tons of peanuts. Then there was a second box (both were sealed well), and inside the second box, each piece was wrapped well. It was an EXCELLENT packing job. Probably the best I've ever seen! I'm sure the other part wasn't in there, I'm hoping I hear back, but so far nothing. Maybe I should have been a little more rude in my e-mail back, but Dad always said you catch more flies with honey than . . .
Her feedback was 15, but it was all excellent reviews, so I thought I'd go with her. It was an item I wanted, too.

Was the fact the item had a broken part in there description.
If not then the Item is not as describe. I Dont think your expectations are to high at all.
really have to ask your self if this was only a set of 6 would you have bid $10 on it is it still worth your money.
If you think yes its still worth your money and a great gift maybe a email notice to the buyer and a warning in your feed back to them might be what is needed.
If you think honestly to yourself No this is not worth bidding on at any price as a set of 6 then you would email the seller requesting to return this item for a full refund.
if you decided the Item is still a good buy and well worth keeping do right the buyer let them know and put the coment in there feed about about not as described.

I have to agree with dman3. Request that you be allowed to return the item for refund or replacement, since it certainly sounds like the item was broken before shipment. Therefore, the item does not conform to the listing, since no damage was mentioned. Don't be surprised if the seller is unwilling to do a partial refund, should you suggest that, as fraudulent claims of this type are too common and most sellers would rather take a loss than encourage the people who are perpetrating them with another success.
