Bid on an auction. The item was meant to be a gift for a co-worker at the office Christmas party. Won the item. Get an e-mail from the seller. I will be going out of town and all items will ship on 12/14. The problem is our party is on 12/14. It did not state this in the TOS. Read it again this morning to make sure I did not miss the shipping date. Sent her an e-mail explaining my problem to her. What can I and what should I do?

I would think you would be perfectly right to cancel the transaction if the seller sticks to this. Sellers are getting very unreasonable about their terms lately. Whatever happened to the customer comes first? I have even been scolded for emailing too soon after winning an auction!!

I recently found out (after I listed some auctions) that I was going to have to leave town for several days. I did not note it in my auctions. However, in my EOA notices I told the buyer something similar to what your seller told you.
Anyone who responded with a problem such as yours, I went ahead and shipped the item without their payment being received. When I returned home, their payments were right here waiting on me. Of course, my items are usually in the $10 range with very little invested. If I were selling $50+ items, I am not sure I would have been so trusting.
Bottom line is that it never hurts to ask. Hopefully everything will come out fine.

Given that many items purchased on ebay in the next 2 weeks can be assumed to be Christmas gifts, I'd say it's incredibly short-sighted of the seller to pull this post-auction.
What do her TOS say about payment/shipping turnaround?
