I won an auction in september
I mailed out a money order, never received the item.
I have MO receipt. Seller did not offer insurance or delivery confirmation.
I contacted the seller several times asking where abouts of package or to send my money back.
She said she mailed package.
What are my options? Is there any way to get my money back?
Seller's feedback is 32, 2 neg and 2 neutral.
One neg for not getting item, seller said buyer never paid.

This is her response to my last email.

Please calm down, I was away for Thanksgiving, I rec'd your emails and I
did tell you that I checked into the package and it was shipped ,
however the problem is it cannot be tracked because USPS has no tracking
# on it unless you pay xtra for it. How we work this out is new to me,
this never happened to me before. I was paid, and I did ship the item
so the fault is of the USPS who told me to just keep a look out & maybe
it turns up?????? I know that does not help your end, I don't know what
to do, do you have a suggestion? Let me know

How expensive was the item? Did the auction listing have any type of guarantee?

My personal opinion is that all sellers are responsible for the item until it is received by the bidder, undamaged and as described. Period.

Stop payment on the money order.

Insurance is an option to protect the interest of the seller. If the seller cannot produce proof of delivery, they owe you a refund. If they chose not to insure the package against loss, that is their problem - not yours.

It is probably way too late to stop payment on the money order. IMHO, In her email to you she is accepting responsibility by admitting she was paid. I would ask for and expect full refund, including shipping charges.

Tell the seller to file a "lost mail" form with her post office. That will triger a check behind and under all equipment, and it might be found sitting somewhere.

If they didn't offer and you didn't ask for insurance or delivery confirmation ... it's up in the air as to who takes the loss. I always offer it and refuse to accept responsibility for anything happening in the hands of USPS.

I do not have a great deal of experience on eBay, but I would assume that it would be the seller's responsibility to offer insurance or delivery confirmation. If you were buying something from a company I would not expect that you would have to request insurance if they don't mention it in their terms of service. I realize this is a bit different than dealing with a corporation, but bottom line is I paid, she acknowleges that I paid and she does not have any proof she sent my package.

I wrote and asked her for a full refund including postage. If she refuses to do anything about this, is there anything else I can do?

It is difficult for both seller and buyer when an item isn't delivered. Buyer has only Seller's say-so that it was shipped and Seller has only Buyer's say-so that it wasn't received.

That said, most good sellers will make good on this. Your Seller's feedback is less than wonderful, but you do have the 'negative feedback weapon' with which to threaten.

Do a postal search and unemotionally request a refund. If you don't get your package or your refund, leave a factual NEG.

Unfortunately over a $10 amount, there is little else you can do.

The post office that we send most of our packages from print out receipts that give the date of mailing, where they are mailed to, how they were mailed and the tracking number if any. It is pretty hard to argue with that kind of info if someone claims you didn't mail a package. My postal clerck said that since the USPS started doing that the claims of mail fraud have dropped. Not all branches have that yet, but most do.

I also thought that most mail centers have receipts like that.

You will be asked to sign something stating, under penalty of perjury, that you have not recieved the package.

Or you could ask the USPS for a mail fraud form and turn it in.

It's quite different buying form individuals than corporations, and a buyer has to defend themselves by being aware of things like insurance and tracking.
