I have a deadbeat bidder who keeps citing eBay's TOS as a reason for not paying. Can anyone please post a link to it for me - I cannot find it.

That's a pretty substantial order
Click on a SafeHarbor link at eBay - you'll find the User Agreement, Listing Policies clarification, and details of which items can and cannot be listed on eBay.
You might want to ask him to be a little more specific.

Don't worry ... just do a NPB alert, followed by a request to get yout FVF fees back and he can explain the TOS to eBay.
It's the User Agreement, and basically it says that if you win, you pay.

Due to unforseen circumstances I couldn't contact him until day 4. He says the auction is void after day 3 and he does not need to pay. All I can find is where it says contact is recommended by day 3. If not, be patient and check feedback.
Anyway, I don't care about not selling the item - his bid was lower that what I paid anyway. I am just looking for FVF credit.
Of course, he did not reply that he did not want the item until 4 days after I contacted him - go figure.
I sent him a NPB alert and he freaked! I even told him in a heads up email that I knew he had no intentions of paying but this is how eBay does it for me to recover my FVF. He has not been nice to deal with. Negged me before I contacted him.
I can't find this specific information - I have been looking but I am stumped.

Seller and bidder are supposed to make contact within three BUSINESS days. If you emailed HIM within that time, you've lived up to your end of the bargain. His not responding doesn't void his obligation unless YOU want to let him off the hook.
Don't waste any more time on this character. He's not going to pay up no matter what. Send an NPB, checking the appropriate reason. Email him to let him know you've offered the item to bidder #2, and then do so. If #2 doesn't want it, relist the item and file for FVF after the requisite 10 days.

While the seller is typically the one who makes contact, an auction isn't automatically cancelled just because the seller didn't - the winner is supposed to make contact if they don't hear from the seller. Send 'em this link, for their future information:

"RECOMMENDED by day 3" sounds correct. People have all kinds of reasons for not being able to make contact in that time frame. Heck, eBah can't even seem to keep it's own system running three-days straight half the time, can it?

Technically, it's possible. eBay does say 3 BUSINESS days, which meand more than 3 days for all but auctions that end on Mon or Tues.
However, there is a way to get FVF without giving him a NPB black amrk. Under reasons, but "mutual agreement", then give him a NEG for being so impatient

Just checked - I DID contact him within 3 business days - he's counting the day the auction ended.
ie: 12/11 - 12/12 day 1
12/12 - 12/13 day 2
12/13 - 12/14 day 3
two emails sent 12/14 If only I figured that out first .....
I think he just spent too much and didn't want it.
Maybe I'll ask him to email the link to the TOS he keeps quoting. After all, he keeps reminding me how he must play by eBay's rules. Guess he didn't read into it enough to realize that there is a FVF.
Check his feedback - trying to make himself look good?

If the so-called TOS says you should contact your buyer in 3 days, and you're taking 4 is the reason the buyer is giving you a hard time, consider this one a done deal. Follow HCQ's advice ...

I was just looking at the listing, feedback comments and responses. It seems that the bidder wanted the item for Christmas and now doesn't want it...
Personally, and with all due respect for sellers, I'm not sure that I would trust on-time Christmas delivery from any seller on eBay. Not to mention that it seems rather naive for someone to be shopping online only two weeks before Christmas. Most of the online retailers had cut off dates for orders around the time the auction ended...
