I sold a digital camera before christmas, The buyer wanted it sent priority. no Insurance. Well to my dismay and the buyers the camera has never arrived, he has stated he has not notified ebay....YET... but will if i dont take care of it. he wants the camera or his money back....Well of course I dont have the camera and I dont think I should give him his money back.. or should i? For all i know he might have the camera. Help Help Help advise please..

Go to the post office where you mailed the package and have them try to trace the package. Advise the buyer of what you are doing and the results. Stay in communication with the buyer and keep your e-mails cool and professional---easier said than done when being called a crook.
Find your receipt to prove you mailed the package. Print out hard copies of your e-mails to and from the buyer and keep them in a safe place. If you don't, I promise you your computer will crash right when you need to get this stuff.

If the trace doesn't work out than you really have no choice but to refund the money. I know there are people here who will say that since the buyer declined insurance you are not obligated to refund but I think that is wrong. I have to assume that the digital camera cost at least a few hundred dollars. As a seller, there is no way on earth I would have shipped the camera without insurance. I would have made insurance mandatory or I would have paid for it myself. I don't know how long you've been selling but you need to cover yourself at all times. There are too many scammers (not to say your buyer is one) out there who will try to rip you off. I would be very skeptical of any buyer who refused to pay a few dollars for insurance to protect themselves when they are sending a few hundred dollars to a total stranger. I hope everything works out for you but it may turn out to be an expensive lesson.

broklnnguy... Well the camera was only 50 dollar item.. but you are right about paying for the insurance...live and learn.... hope the trace will turn something up... if not.... there goes 50 bucks...thanks

How many of you have actually lost a priority shipment? As I understand your post did he decline your insurance? If so, screw him, the claim doesn't ring true. I've sent 750+ items out in 3+ years, most priority, some book rate, perhaps 20 internationally & not 1 item has ever not arrived. Additionally, none were damaged. Figure the odds yourself.
