I posted yesterday about a seller who stole my description word to word on a item I was selling. Well I gotten a reply from Safeharbor as they told me they issued this seller a warning, and they emailed me the letter they sent him. but apperently the auction already closed with a winner so basically this seller got a warning.
Well this seller didnt learn for even after a warning from safeharbor, he puts not one but TWO more of this item later today, again using my description word to word! Doesnt a warning from Safeharbor teached this seller anything? Should I email safeharbor once again? This is really irking me! Any advice would help, thanks!

That's easy! Just replace the pics on your server with nasty porn or bestiality (!!) images and then notify ebay about a certain seller with some nasty and unrelated product images! <evil grin>

That is illegal (Bestiallity is illegal under US Law BTW, and in some states, you can face a Life term for even having Bestiality Pictures), and since SHE is hosting the pics, it can be traced back to her, so she may end up taking the rap also.
One idea a while back was to create a notice that said something to this vein:
THIS PICTURE HAS BEEN STOLEN.
THIS PICTURE HAS BEEN STOLEN.
THIS PICTURE HAS BEEN STOLEN.
Preferablly, in Arial, Red Color, maybe 30 font size.

Ok, forget the bestiality, but some extreme porn would teach him a lesson.
"This was stolen" is letting the guy off easy. I'd want ebay to see the porn and warn him at the very least. Many potential bidders would also email ebay to compound the complaints.

VERY GOOD IDEAS. I did change the pic and put a message on it that it had been stolen.
THE PROBLEM: Since that was MY PICTURE TOO and I had auctions running the message was also on my pic. I couldn't change most of the auctions because they had bidders.
The point is WHY should I have to do all of that. Ebays reaction was to send them PROOF. My reaction was "Visit the auction, look at the code, DO YOUR JOBS!!
How many people have noticed that when there is a problem EBAY just seems to want to make you jump through hoops to keep from doing their jobs.
I thought this would have been a slam dunk.
I ended up basically threatening to take action for copyright infringement but I shouldn't have had to.

Hi ultraman187...I don't know much about this, but is there any way that you can make a change again and instead of putting "this pic has been stolen", could you just put YOUR username and your auction number on it? I think if I was a buyer, I might find that curious and go look at yours.

Don't put stolen, put "Photograph by (your username) please check my other auctions". Then It won't mess up your use of the pictures. They'll get the idea

Hello Ultraman187,
Why not report them again? Citing the earlier warning email so that the eBay staffer who takes the email knows that the person has disregarded the warning?
Despite what some folks think, eBay does care when someone flouts eBay rules.

mrlatenite, Pocono: The problem with what you are telling him to do is that it will also show up on his auction.

This happened to me several times. Each time I sent it to Safe Harbor, each time the seller was warned. EBay told me that his auction would not be ended unless I faxed completed VERO papers to them citing copyright infringement. He stopped for a while, then the item, with my wording, showed up again. I emailed the seller directly that if I ever saw that ad again, I would file the VERO papers. He has not used it again.
The irony of this particular case was that I had purchased an item from him in the past!

Hi, looks like the seller removed the image, BUT the description is still word to word from my auction. PLUS he just put a THIRD one with again, my description word to word. Seems like he is brownnosing ebays!. I dont think I can make a claim that the description is stolen word to word and therefore I hold some kind of a right to the description and the title, right? Or can you? This seller is really annoying!

I sell informational CDs on ebay. A couple of weeks ago I was browsing the listings in my category and I noticed that a "customer" of mine had copied one of my auction listings in its entirety. Word-for-word, even the photos.
I had a friend bid on that auction as it was just about ready to close. It turns out that she also copied my CD. Didn't even change the logo! I notified SafeHarbor and they sent me the forms to fill out to join the VERO program. Best thing I ever did! After I registered, I sent the offending auction numbers to [email protected] and the auctions were promptly ended. The seller relisted them again and again I notified ebay. The auctions were ended again. The third time this seller relisted the auctions, they were NARUd.
I know that there are many abuses by VERO members, but for me it is a lifesafer. After doing a little research, I found 2 other sellers using parts of my listings word-for-word and had their auctions ended too. I found that I had lost over $400 (most of which is profits) in sales to these thieves during the one week period prior to my joining VERO. I have no problem with healthy, honest competition. I have a very SERIOUS problem with someone competing against me by selling my very own copyrighted material and even using my own auction listings.
What I sell truly is valuable information and knowledge gained by me over the course of 20 years working in my field. It really burns me up to see someone profiting from my hard work.
Sorry about the rant, but this thread just sort of brought it out in me.

File the VERO papers IMMEDIATELY!!! This seller could file VERO papers himself and have YOUR auctions ended. And no, I'm NOT kidding. Ebay's VERO program basically recognizes the first person to join VERO as the real intellectual copyright owner. With your email to the seller in question, you kust may have given him an idea of how to screw you but good. If he registers with VERO first, you're screwed. No dinner, no movie, you're just screwed!
