I just need to vent...
I had an auction end a few weeks ago and the buyer delayed sending payment for a week (even though the item was SO important to her, and she needed it SO quickly). I shipped the morning after the payment came (via Paypal).
Now the buyer is looking for the item, I explain it was shipped and three times a day I get more email from her (each one nastier than the next, I try to respond calmly to each.
Today she is calling me a thief and says she is reporting me to eBay.
I am sick of the trouble and just refunded her money (via Paypal). I told her to keep the item when it shows up. I even called her voice mail to get her off my back. (Oh, the item went Bookrate, it will show up, but she can't wait. She liked to price of Bookrate but not the time).
She responds to my refund with three of the meanest Emails I ever got..I call her again and she answers..This time she swears at me and tells me she reported me as a fradulant seller. My refund does not make up for my act of theft..She "KNOWS" I never sent the "****ing item"...I never answered ANY of her emails..Blah Blah..
Now she is reporting ME to ebay for being a Deadbeat seller! I sent a FULL refund PLUS $1.00 to cover Paypal fees, I paid for the item AND postage. Now I am surely get a neg and a complint filed against me!
Would you neg? My fingers are itching to hit her HARD!

Why don't you officially invite her to the thread and then we'll give her her just desserts.

I would think in a situation like that where you were almost assured a NEG from a non complacent bidder, that you should NOT refund the money.
Basically they yelled and whined enough that you gave in....Now they have their item and their money back and what do you have? NOTHING but heartache and a fear of NEG feedback.
A NEG is a NEG but don't be afraid to stand up for your actions.

I hope that you saved everything. I would send it all off to Safeharbor. I would hold off on the neg until I got something back from eBay.
I would also make a complaint to PayPal. I never use them so I don't know what recourse you have there. Good luck

Oh, yeah, giving her a neg is a no-brainer.
But, with all due respect, why did you refund her the money so quickly? I am sick of the trouble and just refunded her money I understand your point of view, but the refund did not end the trouble. The only thing it did was get you the same (or more) trouble, plus you lost your item and your money. AND, she has now learned how to have her cake and eat it too. Just throw a fit and all will be given unto you. I have a 2-year old who has already been taught that won't work. A refund should be a last resort, and only if the Seller truly did something wrong. Don't change the rules for every nut case that comes along.
I am very sorry this happened to you. Take whatever actions you need to defend yourself and your good name against this person. Good luck.

Amen. Of course, that's assuming she wasn't already intimately familiar with this popular form of buyer fraud.
There is an easy solution for sellers who can't/don't use insurance or delivery confirmation: before consenting to a refund, require the buyer to complete the USPS form for lost/misdirected mail.
It has kick-started many a faulty memory.

If I invite her can I give her name in 24 hours? I'd love to debate with her in an open forum!
I know I should not have refunded, but since I did not have proof of delivery I felt I needed to prove my honesty to ebay...I now have a reciept for the refund, so at least I have some proof.
I gave her the neg.. I said "The most difficult bidder I ever had. She has my Sealed Lp and a refund. Impatient".
I also filed a NPB saying that she did not comply with my terms..I did not want to say she returned my item, as it is still in transit to her.
Thanks for listening to me vent, I know you all understand!

I'd like to see some dates here...when was the item mailed? My experience with Book Rate is that it is slowwwww! I'm sure there are buyers that have no idea how slow it can be.

kyms,
From the CG's regarding mentioning Auction I.D.'s - any bolding is mine and not necessarily written into the CG's:
The Steps:
The persons involved are invited to register at AuctionWatch.com in order to join the discussion. The Moderator ([email protected]) should receive a CC of the invitation email, and the invitation email should contain a link to the thread and to these Guidelines. http://www.auctionwatch.com/company/terms.html The invitee should be urged to read and understand the Guidelines prior to posting. Notice should be stated in the thread that an invitation was issued.
The invitee must be given 24 hours in which to respond before discussion can proceed. If the invitee has not joined the discussion within 24 hours, the discussion will then be allowed to proceed without him/her. discussion without identifying the Auction or I.D. is fine.
The member initiating the conversation must have their full name, address, and phone number on record at AuctionWatch.com. Send this information after sending letter of invitation, to [email protected]
Hope that helps you,
Joice

I got the payment on Feb. 5th. I mailed Feb 6th. I do not think it is late yet. She just responded to the NPB...She is calling me a liar, saying I never shipped the Lp... (Right, I have 1300+ positive transactions, some for hundreds of dollars, and I choose her to steal $13.00 from). She is demanding eBay do something about me...I think she is psychotic.

That is why on my auctions I state "free shipping via standard USPS with no tracking or insurance. You assume all risk. You can not pay by credit card if you choose free shipping. If you want speed and security, $4 for USPS priority with delivery confirmation and you can use a credit card."

It's only been 8 business days (counting in my head). It's too early to worry with Book Rate shipping.

You are definitely a weenie when it comes to complainers....the receipt you get from the Post Office has her postal code printed in it. There was your proof that something was mailed to her on the date you said you mailed it.

I always wonder in these situations(assuming it is not some kind of weird buyer fraud) how stupid exactly does the person feel when they get the package. I have never had to deal with someone like this, but IF I had to and they WERE THIS INSANE about it I would just tell them to get over it and if the package doesn't come in a reasonable amount of time then email me back. I would not put up with a bidder cursing me because thier package didnt get there in two minutes. You have my sympathy.

If you have 1300 positives you should be able to brush this one off and move on to others. I sent a person a $5 item the other day via Priority mail and then received his check the day after. (thought he had prepaid whoops!) I will not offer any delivery method that cannot be confirmed. When you ship you should notify the customer of an expected date of delivery (and add a day or two to what the post office says.) I jsut bought a PC card from california and it was shipped Friday and it is expected to arrive today, Friday- Now I know UPS runs almost 24 hours so if you get it in their system the weekend counts (unofficially) so that is 7 days via UPS ground. But a check of their site tells me that..... So the answer is in future tranactions be very clear about transit times. And never dependon the customers honesty (although almost all are). The only dishonest customers I have run into are the ones that you send the wrong thing to accidentally and then the real person that won it wants it and you can't remember who got it. (they never say hey! I didn't order this!)
Good luck!!

Twice I've had "suspicious" buyers tell me the item never arrived. My response:
"I will be glad to settle this matter fairly upon completion of the official USPS lost mail investigation process." (note that I don't actually promise to refund their money - not because I won't (I will if it comes to that), but if they are trying to defraud me, I don't really want to get their hopes up and encourage them to continue their shannanigans).
This process culminates in a federal form that the buyer has to sign and return stating they never got the item.
I never heard back from either, presumably either the item did, finally, arrive or else they weren't interested in committing a federal offense on a $15 item.
Its hard for anyone to argue with my position, in that I'm merely following the official process for dealing with lost/delayed/stolen mail. Fortunately, I sell items that are of relatively low cost, that I don't have more of, so there is no pressure on me to "send another one now while we wait" nor "but I need that money NOW to make the rent payment"...

I sell police and fire patches and at least 1/3 of my buyers claim the item never arrived.....delivery confirmation my friends.....delivery confirmation.....and I have found a nice way to handle undeserved - feedback.......POST A REPLY TO THE FEEDBACK- "SEE MY ME-PAGE" ...THEN TELL THE WHOLE STORY OF THE TRANSACTION....my deadbeat, lying laptop seller....begged me to remove it AND gave me $25.00 back.....granted it didn't help the fact that the laptop arrived 2 months late and via a different shipper than "promised" but it sure was satisfying to see the seller beg and NOW change seller names....hahahahah.....

I do not blame you. I always say that I am not responsible for lost packages and usually send the package with a confirmation. It only cost 40 cents and shows you sent the package! The USPS will send you any amount of confirmation receipts that you can use if requested.
