Is this now a no-no? I know at one time eBay said it was OK, but now with the new email system, the email states no selling off of eBay. Did they officially say this was no longer allowed? I know it is considered fee avoidance, but at one time they did not care.

I believe the most current ruling is that if your high bidder backs out or you can't contact them, you can offer the item to the next highest bidder.

If you contact your underbidders or other bidders w/similar items, THAT would be a no no.

That is what I thought. My high bidder refuses to pay because his son bid on the item (another topic for another day), I contacted the next highest bidder through eBay of course, he responded back to me and this was at the end of his message (which would have come from eBay).
[i]This email was sent by an eBay member via eBay's email forwarding system.
If you reply to the email, your response will go directly to the member and
not through eBay.

eBay does not tolerate spam (i.e., unsolicited commercial email) and is
taking steps to protect members from this abuse. In addition, solicitations
to buy or sell items outside of eBay violate eBay rules and are not covered
by services that protect members such as feedback, insurance, escrow, and
dispute resolution. If this is an offer to buy/sell items outside of eBay,
please do not participate. Enter the following link into your browser to learn more. Link: http://pages.ebay.com/help/email_info.html

It sounds pretty definite that you can not sell and it makes me look like an idiot to the potential buyer.

I think:

A) Most people will not read down far enough in those e-mails to even notice Ebay's little warning.

B) Of those that do read the notice, they will read it once and never again.

C) They will start to read it and get bored and stop reading before they ever get to the part about buying items off of Ebay.

That little warning doesn't concern me in the least.

"Notes: Selling to the underbidder in a Non-Paying Bidder situation is still permitted. However, this transaction is not covered by services such as insurance or Feedback. ..."

Glenda is right.... and from what I can tell... eBays current "preferred" way of handling this situation would be to come to some form of agreement with the underbidder (in the event of NPB for the actual winner) and then relist the item with that as the BUY IT NOW price so that eBay can get their cut and the traders can be protected by the insurances and feedback forum that eBays VENUE offers.
