Check out great collections wine auctions on ebay, saw one listed on the front page they have 5 pages of wine auctions going. I thought that no wine could be listed ?????
"The value of the auctioned item is in the collectible container, not its contents. Thus, bottles of wine are not permitted because their value is based on the wine in the bottle, and not the bottle itself. " from the rules page on ebay itself.

If you look at the auctions it is Butterields holding them and since they are owned by ebay they feel they are above it all.

Since ebay owns the site, they get to do what they want. Not only are they above it all...they are it all

Well, I think that everyone who comes across this auction should email eBay and let them know about it as if we assume they couldn't possibly know about it or they would have already stopped it. I myself am going to send one of the auctions to safeharbor via "send this auction to a friend", with a nice little letter asking if it would also be okay for me to list my wine collection for auction on ebay.

Well Amy, one of the reasons ebay would not let us sell wine is because they said it violated various laws and regulations. So now those laws don't apply to Butterfields?

newguy...I think you have to obtain a permit for selling & shipping alcohol across state lines. It's possible Butterfields holds one of these permits.
It's the same reason you can purchase wine from retailers or online and have them ship it somewhere else for you, but you could not ship it yourself.
I agree though if the eBay rules say you cannot sell alcoholic beverages, then that should apply to ALL sellers.

They would not even allow those with permits to sell any alcoholic beverages. Although an auction of fine wine sneaks through now and then, some even from wine merchants, ebay will end all of those pointed out to them. Do you really think they will end all of those high-priced auctions of theirs if someone does turn it in to Safeharbor? I do notice that the bids are for proxys in a live auction at Butterfields and maybe they feel it is ok to do it that way.

Thank you for your email concerning the sale of wine by one of eBay's
companies, auctioneer Butterfield and Butterfield. As you pointed out,
eBay does not permit the sale of wine on its core eBay.com site -- eBay
enacted this general rule since the sale of wine is highly regulated in
many states, making it extremely difficult for users to lawfully conduct
person to person wine transactions. In fact, the sale and shipment of
wine between unlicensed adults may even be prosecuted as a violation of
criminal law, depending on the states where the participants reside.
Our decision concerning wine sales on eBay was not a "moral" stand
against alcohol, but a simple recognition of the potential difficult
legal issues raised by private interstate wine sales. Such issues are
not raised by wine sales on eBay Premier. eBay does permit the sale of
wine by a licensed auctioneer on its Premier site, though, where (as
here) such transactions are conducted by professional auction houses
thoroughly familiar with the complexities of state alcoholic beverage
sales.

A Seller who sells on eBay is forbidden from selling his/her wares anywhere else on the Internet
Now
eBay changes its rules (or blatantly violates it own rules) so they can be the only EXCLUSIVE wine-seller on eBay.
Methinks they lie too much.....

If the transaction is only between the buyer and the seller and they are only a venue
what are they doing deciding who has the expertice to conduct these?
They are digging a deeper and deeper hole so that when this venue facade collapses in a court case it will truely damaging.

Add to that ebay.disney.com (Disney/Ebay auctions) where they are allowed not only to advertise in the descriptions of their auctions, but also provide links to buy the items off of ebay! An example: A poster for a popular movie with a link to buy the video from Disney "off of ebay."
