I bought a book and paid with paypal a few weeks ago. I e-mailed him repeatedly asking where my item was. I finally rated him bad cause figured he just scammed me. He retaliated by rating me bad and calling me a liar saying I never emailed him, which is not so. He claimed then he sent item out as soon as money was received. I think after all this time, it would've got here by now. No book. Should I file mail fraud? And how do I get my money back from paypal?

Did the seller of this book say which method he was shipping? If its Media Mail (booksellers use this most) then it can take anywhere from 1 to 4 weeks. Or longer, I've heard.

Redskinfan, please remember that the post office isn't always reliable. Just recently, I sent my customer a package **priority mail** and it took over a month for them to recieve it. If the book was sent by media mail, I would give it a little more time. I think it is a bit early to be talking "mail fraud" (even though his statement that you never emailed him is a bit suspicious). Check his feedback- if there are no negatives from people who haven't received their items I would give them the benefit of the doubt. You can go to the post office and file a "lost package" claim (I think they won't even file it until after 4 weeks).

If you paid by PayPal, no mail fraud occurred even if seller did not send the stuff.
This story is why I don't use media mail.

There are several negatives, one very recent, from buyers who never received their stuff. He seems to only leave negative feedback on his buyers and they're retalitary. I don't know how he mailed it if he did at all, because he still won't answer my emails. What I said he said is what he did when he posted retalitary feedback and his response to my feedback. He still won't respond to my e-mails. I had a guy at the post office tell me before that as long as the person was intending to send it through usps that it can be considered mail fraud. I just wonder how many more months I have to wait to file...I forgot to ask.
I live in a small town and the post office workers know me and my family. I've only had 2 other sellers jip me, but all my other transactions went well. I buy lots of stuff from auctions, so I guess that's a good track record. I just hate being jipped.

hmmmm now this guy is e-mailing me (I just now got it literally) and is getting threatening about the whole thing. He publicly stated that he never received an email from me, yet he states in this email to me just now (first one I've got from him since I paid a long time ago) that he e-mailed me back each time. Dude can't make up his mind.
Oh he just emailed me a second time in a row cussing me out and stuff some more. He knows where I live and if I don't stop talking about him, etc etc that he'll come to my house and make sure I shut up. WTF????

I'm not at all defending what seems a genuinely obnoxious seller, but ...
Let's imagine George needs legal advice. George walks in under the shingle, and the receptionist says, "Consultation is $200, can you pay that now?" Now George can't afford $200, but he formulates a plan. George says, "I don't have my check book, can I send it to you when I get home? I'll send it immediately". Receptionist says "OK". George consults with the lawyer, and goes home. But George never sends the check. He never INTENDED to send the check.
Would George be guilty of the federal crime of mail fraud? No. George may well be guilty of criminal fraud, but not mail fraud.

Now he's e-mailed me five more times. He claims "it is people like you that hurt my daughter she had surgery because of you" I left off the bad language. He now claims he only sent it out a few days ago. I paid weeks ago and he only sent out few days ago??? but in the feedback he said he "sent it out a long time ago." this guy can't make up his mind.
Thought safeharbor didn't act on emails??? that's what I've read in posts....

I'm not sure whether safeharbor will act or not, but it will at least be on record that you've reported the threats.
It sounds like he's full of anger for whatever reason and misdirecting it at you. I'm sorry you've fallen into this bad situation!

I took a shower, come back, and this guy sent me some more emails. In some he's trying to say I either didn't pay him enough or something....
I did some checking on his feedback on this and some of the other ebay names he has that he gave me in his EOA email and this dude buys A LOT OF CLOTHES from auctions. Draw your own conclusions....

Oh my goodness, Redskinfan! I guess it is safe to say that you need not give him the benefit of the doubt now. He sounds scary. Make sure you keep all those emails, email them ALL to safeharbor. Contacting the police in his area (hopefully he is not in your area) and forwarding the threatening letters to them may be a good idea (I believe others have gotten pretty good results from this). It's enough to make me want to get a PO box. Please keep us updated - I wish you lots of luck. He sounds pretty unstable. If you need to make any contact with him, I would keep it short, calm and unemotional.

Received new emails this morning. Now this guy says he'll have me arrested for slander and sue me for more money because the book was worth more than I paid.....

Now the guy filed a NPB notice and I got an email reminding me to pay the seller. This is ridiculous. I had even forwarded emails to that address at safeharbor last night. What should I do now???

He sounds like a nut. Contact police regarding threats. Can you block emails from him? He is harassing you. Sorry you had to run into this loose cannon.

You say you paid w/PayPal. Have you looked to see if the money was accepted on the other end? Have you made SURE you sent the PayPal money to the correct ID?
It can happen if you accidentally type in the incorrect PayPal ID for the other person.
First, I'd make sure the PayPal ID was correct & that the money had been correctly transferred to his account.
If it has, then there is a procedure for buyer being able to responding to the NPB. Here's the URL where you can learn about the appeal process.

"Should I file mail fraud?" - At least consumer fraud. There are a number of recources.
Regarding e-mails, I've had to use the Computer Crimes Unit of the FBI once over an e-mail harassment issue. Often copying the e-mails to the senders provider will do the trick.

Yes, it was received weeks ago. Same email address as his and exactly the one he gave me. I know he received money. and why would he have said in his feedback that he sent it long ago if he had not received the money???

I just received the book today. It's postmarked a few days ago. Paid 2/8 and he just now getting around to mailing it off. Had to rate him bad to get it mailed. (Postmarked day after I rated him bad.)
Safeharbor wrote back that they don't get involved in email disputes. *sigh*

I'd be worried, big time. The seller is a whack. I wouldn't answer the phone or the door. Get a gun or a big dog for protection. Don't go out if you can avoid it. Have friends bring you food or do your shopping for you. Good luck and enjoy your on-line experience.
