Below is the story I wrote on hear last week, now one week has gone by and my sales are down 95% I warn ebay this was going to happen! I am a really good seller. My 800 postive feedback state that. 6 of my 8 total negative feedbacks are from deadbeat bidders!
but the last 2 neg's are killing me! This is the wrost week I have every had. Ebay will always let deadbeat bidders have more rights then the sellers!
Ebay will Not remove two Negative feedbacks left by one user. Hear is the story, this bidder won the first of my auctions on April 29, I email him with details, the same user won another one of my auctions on May 01, I notice he was the same user so I said let me check out this guys feedback, well he was listed as a private feedback with 6 negatives in two weeks!
So I sended out the second email requesting a Money Order. This was so he doesn’t send me a bounce check. Well by 4 PM that day he Neg me for both auctions.
This was the feedback he left for both
“seller sticks nose where it dose not belong this is why I hate ebay!!!
He also sended me two emails (words have been blocked out by me)
“by the way $sshole that 2 negitives from @icks like you last was a reponse and seller is working things out with me unlike #uck heads like you”
“enjoy you negatives $sshole don’t email me back I will not read it go to wollowing with your other #ucking pig sellers on ebay”
This was the response I received from ebay!
Hello, Thank you for writing back to me about your feedback removal request. I realize that you are upset about our decision, and I would like to further explain why we cannot remove the remark in question. As outlined in the removal policy, under federal law (the Communications Decency Act), eBay is not legally responsible for the remarks that users post on its site, even if those remarks are defamatory. eBay provides its feedback forum and its boards as places where users can express their opinions, and eBay will not censor these opinions, or investigate the remarks for accuracy. In order to prevent liability, and maintain protection under this act, eBay must refrain from removing any comments that do not fall into the special areas outlined in that policy. Unless feedback meets the guidelines outlined in the removal policy, we cannot remove the comment. This can even include situations where the comments may be inflammatory, slanderous, or untrue. While these types of comments are strongly discouraged, they would not be grounds for removal of a comment. I can understand how receiving undesirable email can be unsettling. Unfortunately, email between members is considered private correspondence and is beyond eBay's jurisdiction. However, I do have some suggestions for you. Whenever you encounter unwanted email, the easiest thing to do is block the sender's incoming emails. This is a feature provided by most email programs. Please consult the help section of your email program on information on how to do this. If you cannot block the emails, simply delete the email, do not reply or respond. It is always best to not escalate an already tense situation. You may also want to contact this person's Internet Service Provider (ISP) and make them aware of the type of email that you have been receiving. Although we can not handle these types of complaints, the member's ISP should be able to help you resolve this unfortunate situation. To do this, look at the senders email address and substitute the word postmaster in place of the name in front of the @ symbol. For example, if the email was sent from [email protected], you would send your report to [email protected].
The best is ebay wants me to report him to his internet provider. This sale was made using ebay as my sale agent. Ebay again wants to dart a bullet for a deadbeat bidder. What are your feeling about this repsonse from ebay!
Your comment is insulting and a violation of the Community Guidelines. Please do not post in like manner again. To do so could place your posting privileges in jeopardy.

This was written to me by a Auctionwatch and ebay user! He's the one that still allow to write emails and feedbacks like this. I guess you didn't read the story from the top!

cmsspu; I've heard on here, (haven't experienced it myself) that if you respond to the feedback and include a full name or email address, (doens't have to be real!) that ebay will remove the feedback. You might want to try that.

You deserved the negatives. You changed the terms after the auction. If you didn't want to deal with the buyer, you should have canceled his bids before the auction ended.

To Yankee98champs
Yes I did change the terms after the auction ended, so would have you. Most deadbeat bidders will bid late or last minute on your auction as did this one. He received 4 of his 9 negatives in two days for not paying auctions that ended 21 days ago. On his first auction win I left the terms as is. After the second auction I checked his feedback rating, that's when I said this guys a deadbeat! He's only on ebay to give negatives. Because I change the terms gave him no right to give me a negatives the same day the auction ended. If he had email me stating can I please take a check, that would have been fine, deal close. It's hard to check a winning bid 3AM. Ebay should have removed these feedbacks!

If he's a "deadbeat", and wasn't going to pay you, what did it matter what payment he was "not" going to send you????
And, NO I would NOT have done the same thing.
Yes, he did have a right to leave those negatives. You decided you didn't want to sell the items at the terms that you listed them. So you gambled and lost.

Respond to each negative honestly, apply for your fee reimbursements from eBay, and move on. If you're the 3rd person filing for FVF credits because of this loser then he/she will be NARU in no time.

Surely you must be mistaken. Poster after poster will line up to let you know that a few negs will not harm your business. Maybe your bids fell off due to another reason? Yeah right!
There is a solution to your feedback nightmare. Just leave this feedback:
"John Doe is a horrible ebayer!"
(Substitute the bidder's name for John Doe.)
Then use an email account not associated with ebaY to notify Safeharbor that there is a feedback comment with a real name in it. The feedbacks will be removed very quickly.

You changed the terms after the fact.
You deserve to get the negs.
If I received changed TOS I would have done the same thing.
You should have completed it like any other sale, held checks to clear just like other sales, if they didn't pay just file NPB & FVF
Though I doubt sales being down is from 2 negatives.
I had a similiar situation not too long ago and my sales weren't affected.
With such a high feedback the negs will bburied in no time at all.

ok listen up!!!
I have had 6 feedback removed in 2 years and they do remove them if you keep at them !!!
The way i would go at this one would be that the comment given was not related to the auction!!!!!!
seller sticks nose where it dose not belong this is why I hate ebay..
I have done that many times . All 6 times i was told no the first time somtimes even the sec...but if you keep at them...they will listen...i personally think they are told to say no the first time!!!

I got an idea !! Leave a negative feedback for ebay for a response in how they unfairly treated this persons neg. See if it gets removed or if they claim they have no responsiblity !
posted on May 13, 2001 11:14:28 PM
you did change your TOS, but I think that the persons response to that was too harsh. ebay does claim that feedback is to be transactional but you'll be hard pressed to have them do anything about it. they really could care less because where else are you going to go?
another thing they will tell you to do is contact SquareTrade, pay your 5.00(I think that is what it costs now) per neg. and maybe get them removed. well that only works if you can talk and reason with the other person so really that doesn't look too promising.
I would really like to see if this name thing works.
something like:
Sorry John Doe, I wish you had given me a chance to make it right.
john doe 1234 his street, any town, AZ 92215 please contact me
now john doe you know you need to take your medication everyday
more than likely they would delete your response to the negative feedback, the feedback would stand, and they would warn you that if you do it again you'll be suspended(because they could care less about one customer) and wait with their finger on the NARU button for about 10 seconds. which is to say that I have been told about a dozen times that "this is going on your record if you do it again it is grounds for suspension"(wow just had a high school flash back) when I have been on the phone with support I have asked about "my file" and they have always said they don't see anything on "my file". Makes you feel like we are at war, war? cold war? police action? conflict? well something, with ebay and they have a secrete file on all of us, they know everything about us and if we talk to the wrong people.........oh no I just heard a knock at the door.........could it be the ebay Gestapo?? I better go break out the hardware!
