Just received a telephone call from eBay's power sellers. We were reported for being in violation of eBay's new policy. They do not and will not allow Auction Watch to add a link at the bottom of the auction template saying "Join My Mailing List". Just wanted to give a heads up to other eBay sellers - not just power sellers - that you need to make sure that you do not have that preference checked or eBay will cancel all your auctions.

Supposedly Auction Watch was suppose to notify all of it's members that used this preference. I haven't received any such notice from them.

The "no mailing list link" was apparently put in force back on May 7th, according to the info Andale was passing out... I was sort of surprised NOT to see anything here about it..

I'm glad I put my mailing list offer in my Invoices that go out with the items...

I was concerned at this, and sent email to ebay, specificially asking about the mailing list links. This is the reply I received on May 11, 2001:

"Hello,
Thank you for writing eBay. I apologize for your recent frustration but I wil be more than happy to help you with your situation.

I have reviewed your questions in your previous emails and I have researched each one of them. We do still allow your mailing list option link on your description as well as PayPal and BidPay options. Ihave reviewed some of your previous auctions and see that all of these options are available at this point in time. If there is a specific auction that you are concerned with regarding these three options please email us back with the item number you are referring to and we will help you with each auction.

Good luck with these, and future auctions with eBay.

Not only did we receive a phone call from eBay but we also received an email from them. Here is a copy of the email we received from them. I have blanked out the pertinent info so that AW won't cancel this thread.

Dear newattitude,

We appreciate the fact that you chose list the following auction(s)
with eBay:

Item Title: XXXXXXXXXXXXXXXXX
Item #XXXXXXXXXXXXX

Unfortunately, your auction indicates that you are requesting other
potential bidders to join your mailing list, which is not permitted.

We realize that you may not be aware of this policy, however,
we do not permit email gathering devices on auction listings or on
About Me pages.

Our User Agreement state the following:

"Listing and Selling.
5.1 Listing Description. Listings may only include text descriptions,
graphics and pictures you supply to our site (or that you link to
from our site) that describe your item for sale (or as appropriate,
for which are soliciting offers to buy)."

The User Agreement can be found at the following URL:

In addition, gathering these email addresses from your eBay auctions is
inconsistent with our Privacy Policy, which states:

"5. Your Use of Other Users' Information.
By entering into our User Agreement, you agree that, with respect to
other user's personally identifiable information that you obtain through
the Site or through an eBay-related communication or eBay-facilitated
transaction, eBay hereby grants to you a license to use such information
only for: (a) eBay-related communications that are not unsolicited
commercial messages.."

Please be aware future incidents of this nature can lead to further action
against your account. We value you as a member of our community and

violations of the Listing Policies or User Agreement in the future.

We thank you in advance for your cooperation.

This kind of reminds me of when IRS first started their HELP line. You could call 3 times, speak to 3 different people and get 3 different answers! Used to drive me .

Then, they started putting their disclaimer out there that the information you receive may or may not be accurate. If it wasn't TOO BAD! You would not be released from your responsibility.

I discovered a long time ago "right hand does not always know what left hand is doing" on eBay!

Where eBay is tougher than IRS, is in the fact eBay can cancel/suspend without notice. At least IRS notifies you before taking drastic steps!

We recently had a thread here concerning eBay banning mailing lists on the auction listing page. I'm totally amazed that AW didn't remove the link and notify it's customers about eBay's new policy.

Is anyone AWAKE out there?
