Good Morning Fellow Ebayers... ATTENTION PLEASE!! IF YOU ARE A SELLER IN NEW YORK STATE...!! You need to be aware of what our State Legislature is wasting time and money on now!
http://www.assembly.state.ny.us/leg/?bn=S427
Requires dealers of second hand articles to maintain records of second hand articles bought and sold in the course of business; regulates the business of the sale and purchase of second hand articles; imposes fines and/or imprisonment for violations. (Be sure to click on "See Bill Text"
Yes...this can apply to YOU and you could go to JAIL if you do not comply with this madness!!

Works for me...the only sellers I ever have problems with have been in New York, so anything that puts the screws to 'em so they clean up their act is fine with me.

Pawnshop owners are covered under different laws. This applies to folks like us, auctioneers, 2nd hand stores, ANYONE who deals in used merchandise. Read it carefully!!
You have the same thread open in AW Round Table and Ebay Outlook. As you may know, this is not allowed and is considered "spamming." I tried to send you email to ask which thread you wanted to keep open, but your email address we have is invalid. Therefore, I am leaving the thread in the Round Table open and I am locking this one. You may want to review the Community Guidelines concerning this and avoid it in the future to protect your posting privileges. Thank you for your co-operation.
Since you posted this in only 2 forums, I have been advised by my supervisor it is not considered "spamming", and I am unlocking this thread as well as leaving the one in the Round Table open. My mistake and you should be able to post in both forums now.
Thanks for using auctionwatch.

What are we supposed to do? Take our "bound book" to tag sales and ask them for id? Funny how cars are exempt (if I am reading correctly)since they are stolen all the time and I know, from experience, they will NOT even look for it.
These rules and regs are getting more ridiculous every year. Can see the logic with certain items - weapons, cars, high end jewelry - but then again if the person trying to sell was acting nervous wouldn't an HONEST dealer contact police anyways and get id. Do they really expect the fence to keep a "bound book", boy did that just conjure up all sorts of images in my head!
By the way, RedCircle and Seyms many of us in NYS are not only honest, but friendly and will go out of our way.
That's my two-cents, guess I had to vent

Thanx cyberauc for the info......
Ok, so take the cops off the streets away from the drug dealers & the gang members, put them on the "second hand store" beat so they can spend their days checkin' the bound books for sale histories...Yeah, right!!.....I can see the logic in the law, but the application does not seem feasible or enforceable
If only we could get rid of all the NY sellers & the AOLers eBay would be paradise!...LOL! (For The Record, I am BOTH)

Gee, since when has NY been a dirty word in the Ebay auction biz? If you post your Ebay ID's, I would be happy not to bid on any of your auctions. I am from Upstate NY, and I have never been a problem bidder..and I have never had a NY problem bidder (BTW, I also never have problems getting and sending mail from AOL, or relisting on AW LOL!).
That law is an ammendment to one we already had...very few small changes. It's meant more for pawn shops and second hand dealers.

Much more than that DMRick... I don't think you read the whole thing... I am a professional auctioneer, my entire family is connected to the auction industry and this is NEW legislation that will have a negative impact on ALL sellers of used merchandise. Be laid back if you like but if this passes and all of a sudden they come pounding on your door in the middle of the night...well, we tried to warn you!!

if you get your car stolen around here, you're fined $100. There was a big stink about it when it was passed/enforced, i.e. letters to editor, but as far as I've seen in the paper, it's still on the books. It suks.

DMRick, pls understand that MY post was sarcastic. I am a NY seller who's ISP is AOL, and I have never had a problem with either....I LOVE NY!
cyberauc, do you really think that there will be door bangin' action, or is this legislation more about authorities being able to obtain information in the case of a crime already committed?....So, in other words, as a reseller of used goods, should you purchase a item that somehow links to a crime & you do not have the proper "history" you are fined, primarily as a deterient for those who sometimes acquire merchandize who's origin is somewhat shady?...Between 2nd hand, thrift (non-charity) & antique stores there must be approx. 40-50 in my area & I just can't see how our police would have the manpower to check these stores regularly.
