If you purchase an item that was misrepresented on eBay (with a "doctored" scan) then contact the seller for a refund, who ships first? Should the buyer expect to get a refund before returning the item, or should the item be returned before the seller sends the refund?

mmmmmmmmmmmmmmm, yeah, but they do.
That's one reason I quit catalog shopping years ago with Sears/Wards/Penneys. I just had to return too many items. Cheap Fabric, shoddy dishes, itchy sheets......... not just unclear descriptions but claiming a quality that when item(s) are examined "in hand" I found quality lacking. Not all of their items, of course. Just found it to be a roulette. Don't wanna play no more.

You better believe those catalogues lie. If you turned those models around and saw how they were taped and pinned up, you would be amazed. When you see a model sitting down, do you wonder if it is because the pants she is modeling are funky fitting? I do. Do you think the vendor wants you to see their pants look like crud on a 5'11" model that weighs 120 pounds? Heck no. Just imagine what they would look like on a "normal" person.

Do you think the vendor would advertise and charge you premium bucks for a red pair of pants then supply the cheaper blue ones at the same price?
I have decided in the interest of International peace (!) to return the item then await a refund.
fyi, the item in question is an Emmy Consideration VHS tape. The listing clearly stated that the tape was sealed and had never been opened or viewed. The scan "looked like" the tape was sealed, but kinda hard to tell. I had a buyer for it, but only sealed.
When it arrived, it wasn't sealed and my buyer ended up telling me she wasn't interested. The package had not been opened by Customs. As a matter of fact the tape was in a sealed priority mail box which was put into a padded outer envelope.
I think the seller, based on previous listings where he has sold numerous copies of this tape, simply screwed up and put an unsealed tape in the package.
Now I have to sit back and hope I get a refund ... we're talking a substantial amount of dough here (around $200.00 US).
