I have just recently begun using Paypal to buy things on Ebay. I just received an item, and it arrived with a piece broken (not in the box). It wasn't mentioned in the description...only that it was in great condition for it's age...no mention of the broken piece. Photo of item was of another angle. I don't think the seller deliberately deceived me...I didn't notice it myself until I was washing it..it is a big item, and the piece is on the back bottom. ANYHOW..to the point. How do I go about a charge back. I looked through paypal and could only find something on fraud...which I don't think this is..yet. I wrote the seller. What is the protocal in a situation like this? Would appreciate any help ....Anne

Why would you want to do a chargeback before you have tried to work things out with the seller?

I would advice you to talk to the seller. If they did not know about this, give them a chance to correct this situation.

How anyone could miss this kind of damage is beyond me. How ever, things like this do happen once in awhile.

Do let us know how it turns out. Best of luck.

If it comes down to the worst, talk to your CC bank.

I agree. Sounds like you are jumping the gun. Try to work it out with the seller before you go doing a chargeback, which will end up costing him money, and could possibly screw up his paypal account.

Didn't you insure the item?

I don't want to cause any problems for the seller. I just thought that was what I was supposed to do. I didn't think she'd want to take the time to mail me a check. I didn't know it would cost her money..I am still learning. BUT..I am still waiting to hear from her..will not do a thing until she writes me...She has been very nice through this whole thing...even to the point of lowering her shipping cost when I asked her ( It WAS very high). Thanks.

Update.....It took a couple of photos, but she finally believed me and agreed that the item was damaged. She is going to do a chargeback for the full amount and I am keeping the item...she doesn't want to have to pay shipping. I feel badly, but I had planned to resell someday, and can't sell a broken item. She was very nice about it.

Sure you can! Half the stuff up on eBay is broken or damaged. You just have to find someone who really wants it or doesn't read descriptions....

ONE last question.....I now have the chargeback. Does this amount go back to my credit card? I don't have a selling account with Paypal. Thanks for your help.

The chargeback will go to whatever you paid with. If you paid via CC, it will get re-deposited to your card.

Anne,

Having a "selling account with PayPal" (by which I assume you mean "Premier" or "Business" accounts) has NOTHING to do with your transaction, or whether the money gets credited back to your credit card.

If the seller just PayPal'd your purchase amount back to you, and you now have the money sitting in your PayPal account, there was no CHARGEBACK involved. Only the BUYER who SENT the money (and charged it to his credit card in the process) can do a "chargeback", which is a request for a credit on your credit card in the amount of the disputed purchase price, a request which YOU must make to your credit card company.

It sounds like the seller just sent a refund to your PayPal account, which you will have to TRANSFER to your credit card in order to get the credit there.....or TRANSFER to your bank account as a deposit (you haven't said what accounts you have registered with PayPal for electronic transfers).....or request that PayPal mail you the money in a check (for a $1.50 fee). If you don't transfer it back to your credit card yourself, the money will just sit in your PayPal account until you use it to pay someone else, and your credit card statement won't show a credit for the transaction.
