i sold an item to a bidder in italy for a nice sum. i sent it global. he paid with bidpay and the m.o cleared. i just received email from him saying its on its way back and customes wanted a fortune from him. he still wants the item but wants it re sent by a private carrier and he wants me to not declare value.....any suggestions? what private carrier should i use. he has offered to pay for it........i feel an international nightmare coming on.

As I'm sure that many will tell you, lying on the customs form is a felony.
Did you specify in your policies that all customs fees are the responsibility of the buyer?

At this stage I would consider the deal closed, I would not do anything more for them.
Now they want you to waste more of your time and lie on the customs form ? I would refuse the parcel if it came back.
Its up to them to see what duties they may have to pay, but that is not your problem.
Just tell them so sorry but you can not help them, then put them on Ignore. No refund in any case.

that is what i thought however he took it opon himself to tell me it was coming back after the fact. so now i dont know what to do. i sure as h*** am not going to break the law for this guy.
i do not have anything in my terms about customs but will from now on.

I have run into the same problem with overseas bidders wanting me to put "gift" on the customs form. I firmly say "no" under any circumstances.. I agree, to do so would be a felony, and who are they going to go after.. YOU!

As I said, refuse it if it shows up, they should of ask first. Do not allow them to control the situation or you .

what happens if i accept it?? i want him to have it and he wants it and would gladly re send it legally if he pays the shipping again but now i am worried if i accept it i will get stuck with the postage 40.00

I'm not sure.. you might want to give your local post office a call on Monday to ask what happens next..
My only concern for you would be some sort of recourse from bidpay. Have you checked their pages? What happens if he refuses the credit card charge.
Ultimately I think you are totally in the right on this matter, but he could make your life miserable in the process..

He cannot do a chargeback with Bidpay. If you resend it by courier the customs form and fees will still be the same.
If you refuse the parcel, it will go back to them.

ITalian csutoms assesses 20% of declared value of antiques and other items.
if you go to a private carrier say ups or fed exp or dhl,you still have to tell them what it is ??
what it is is keyed into their computer along with freight and destination,out spit the total including the italian customs duty.
there is a better chance of clearing thru customs with no or less duty if you go the private route,as their men in italy will take all thier packages to customs and the italian customs agent may take their word for it.
so in a nutshell,it is up to you to tell the private carrier when you bring them the shipment and fill out the form as to what it is,to reduce the customs duty.
what is the item,may i ask?/

According to pretty much ALL Customs centers worldwide, the Duty fee, if any, is the responsibility of the IMPORTER, period.
Personally I would refuse the parcel.

i am refusing it. this is bull. i checked him out and he has bought plenty on ebay and he is aware of customs cost. the deal is done. i will probably get a neg. 675 positives with no problems and some guy who wants to cheat customs might neg me. oh well! it was bound to happen....i go out of my way for my customers but breaking the law is asking a little to much.

As far as customs forms go, do we declare the value of the bid price or the bid price plus shipping?

Dave61 ........ Only the price of the item, NOT shipping costs.
Breinhold ......... Good for you! IF the buyer wanted special treatment, he should have asked BEFORE he placed his bid, and certainly not *after* the item had already reached his country.
Customs & Duty rules & regs need not be explained in your TOS, it is the IMPORTERS obligation to understand the rules & regs of their country.
And yes, that goes for Canucks as well.

italians are known to keep 2 sets of books ,one for themselves and one for the tax man.
this italian is just giving his us dealer a chance to rethink the intrinsic value of the item,from the land of michaelangelo,what is this item made of and what is it really worth??
a stone figurine is better than a rare ching dynasty imperial jade goddess with ruyi on lotus stand!!
an empire building gift shop ceramic ashtray is better than french sevres handpainted 18th c haviland charger!

i told him no and now he is not responding. i tracked the package and its sitting at the post office down the street.. contacted bidpay and they where great! they say the money is mine and there is no way for him to stop payment with his credit card. monday i will see whats up with usps. an ebay adventure. the stupid thing is if customs charges 20% he would save about $60 at customs after paying for shipping the second time and asking me to break federal law. if i get a neg on this i will be proud of it!
