I saw this in a TOS of a closed auction and wondered what people thought of this policy.

FEEDBACK POLICY:
If the seller contracts in bad faith or treats a winning bidder unfairly, giving the seller negative feedback might be
appropriate; however, any bidder or auction winner that negligently or willfully leaves any false or misleading e-bay
feedback for the seller, agrees to pay the Seller $500.00 (five hundred dollars) in liquidated damages for every
month that the injurious feedback remains available for public consumption.

Do you think it would be effective, or do you think some bidders would just blow it off?
Who knows, I could be wrong. Does anyone else have a policy against negative feedback in their TOS Agreement?

You have got to be kidding me!!

Obviously, a thinly veiled attempt at NOT getting Negative Feedback, when he should desreve it in some cases.

The seller is ultimately gonna decide what feedback he deems "Fair" while he shrugs off the rest as "Lawsuit Bait." What's to stop him from deciding that ALL negative feedback, whether warranted or not, hurts his business??

I'd be surprised if HE get's into trouble when a bidder takes him to court over excess handling charges and the like.

And as a bidder; no thanks, I've been sued by the RIAA and Microsoft this week. Maybe next month.

i think its laughable. i would love to toy with that joker and just see how much BS he can put out. people that toss around legal threats are just too damn funny. who exactly falls for that kind of crap???

Any seller that has any BS like this or any very negative rules about buyers, I don't even entertain buying from them. I have many times bought from another seller if the seller seemed to have a chip on their shoulder.

Sounds good to me!

I usually just tell them that if they leave me a NEG, I'll have the Kelly twins (Guido & Luigi) visit them for a few innings of Deadbeat Baseball

I have considered charging a late fee.

I accept personal checks, but not from those who have required payment reminders.

I guess deadbeats don't care if a late fee is charged since they won't be paying anyway.

Check that seller's drinking water unless he is ingesting or inhaling something known to cause psychotic episodes.

There's over 42,500 current auctions on ebay that state a feedback policy of some sort, and probably much higher depending on the search you do. Of the dozen I checked with high amounts of bids, they all stated 10 days to pay or a negative would be given. But, the listings were so long and wordy I bet only 1 in 10 of those buyers ever looked at the policy and may be in for a surprise.
