Wasn't the BidBay.com address purchased off of eBay? I'm sure that's going to be an awkward point when that comes up.

It's amazing how a little letter can make all the difference. Here, I was thinking that
the post first stated that ebay was suing
www.bidPay.com I read the article and
was scratching my head until I actually
typed in the domain name www.bidbay.com
and realized my error.

Just thought other users might find my stupidity amusing!

I was thinking the same thing. While reading your post, I was so confused, then I finally realized what was going on when I read RB's post. I'm surprised BidPay isn't suing BidBay, too!

Isn't it amazing how the human brain works. The brain takes what our eyes are actually looking at and makes it something we are familiar with. I had never heard of BidBay until today (then again maybe I have, and just read it wrong.....)

So the "bay" in eBay was supposed to denote a trading place which is a safe harbor and not anything to do with their city of origin... yeah right. I'm sure those Pez dispenser traders were terrified and desperately looking for a high security area.

If they are going to persue that then they need to sue everyone who uses the term "Bay area". Who knows, it could mean an area on eBay.

This part kills me...

Oh what a tangled web we weave....

RB--nope, BidVille is suing PayPal, not vice versa.

Anyway, an interesting bunch of slop going on these days, wouldn't you say?

And personally, as much as I disdain eBay I think they are right in this. BidBay's original design didn't look anything like eBay, then because of a post somewhere I ended up taking a look at their home page and you just know where the design had to have come from.

Wait lets just give bidbay a shadow of a doubt here ebay is the one that just change there look a few weeks ago.

So who is stealing what from who ebay changed there look just before free listing day the end of june ????....

Now suddenly they are sueing bidbay for stealing there look give me a break...

these companies would need to try and work out there differnces togeather before you spend a ton of money on law suits this the ebay website design isnt hardly a month old yet.

Perhaps eBay feels they own the e also. Can ePier be next. Also ebay stole epiers light purple color. Maybe they are getting worried perhaps gegy will get them.

Seems I remember (someone may can verify) that eBay sued someone in Austraila that had used the name ebay since sometime in the 50's or 60's.

Nonsense ebay wouldn't dare try to sue someone who used the ebay name 30 or 40 years ago since this would make them the original trademark and copyright holder and ebay would lose any rights to it in less the original person wanted to sell the rights back to them or lose there name all togeather...

Yup thing is Ebay don't stand a chance in hell with this one the other company has been doing business with this name long before ebay auction came along I have a lawery right here shakeing there head NO it dont matter how much money ebay auction throws at this one inless its to buy the rights from the original owner.

its not posiable for the original Ebay to be useing ebay auction reputation if anything else its the other way around

No nobody has to give up the right to a trade name they have used rightfully for years it was there trade and reputation frist this company was around long before the web and nearly before public internet its self.

Look here is what it is all about when your ebay and you have $$$$ you have to spend and invest plenty of it or the tax man will eat you alive

They need lots of losses to cover them selves,legal battles are one sure way to do it win lose or draw these battles cost money ..

they also make out on the free advertizeing from them

Winning a civil dispute is usually determined by who has the biggest war chest of cash and not who is right.

eBay can stretch a court fight out and make it very long and expensive.

I just read an article about meritless patents being filed and the owners collecting licensing fees, even though the licensees know the patent is unenforceable and invalid.

Yet, it is cheaper to pay the license fee than to litigate.

Actually egreed has changed it's design several times over the past 4 years so they really can't complain about anyone stealing from THEM!

Because our legal system and its Judges are a gutless bunch of cowards, eBay, Inc will just run the other company into bankrupcy making it all moot and buy the name for pennies.

If I were the judge, not only would I disbar and jail the stupid lawyers who should have known better than file the suit, eBay, Inc. would have to change ITS name and pay the REAL EBAY a 10% of the lifetime gross revenues as compensation for stealing their name and then trying to harrass them.

Like people, some companies are to stupid to remain living.

I think some posters here are forgetting the "Mc" legal wars, and the hundred or so "Hamburger King" or other spellings of "Burger King" restaurants which receive threats of lawsuits if they didn't change their names when the big boys rolled in.

Trademarks are not like copyrights. Trademarks must be registered to even exist, and it's first come first owned. If someone registers one, they get to enforce it, regardless of how long someone else has been using it.
