Maybe the only way to protect yourself is that the funds have not been converted by you, eg: MO cashed or check deposited. Any financial instrument has to be either cashed or deposited or it is worthless. I don't think you'd collect pieces of paper, either currency, checks or $$. You can ask him for a MO #.
The buyer can find out if the payment was converted.
I have a real feeling that you are being lied to, and he never paid. Of course, you may end up with a NEG regardless of your innocence.

Just tell the Buyer to place a "Stop Payment" on their Check and send a New Payment. It is possible for the USPS to take forever on 1st Class Mail. I had 2, one to NJ, one to SC. The SC finally arrived, the NJ Seller I told to rip off my Signature if it arrived and I sent a 2nd Check. I received the Item (Seller did not wait for my 2nd Check to Clear) and one week later, an envelope with my "Voided" 1st Check. Seller and I have no idea what USPS did wrong, but both of us handled it in an polite businesslike manner. -PJ187-

I asked him to fax all of the information so I can check with my bank. However, It never arrived to my box. If I sent a payment a month ago, I would be wondering where my item was. I would of written to the seller and asked.
After a year of doing this I should consider myself lucky this is the first time I encounter this situation.

You say he didn't send the payment.. How do you know what he did or didn't do? You would have no way of knowing his actions unless you were with him 24 hours a day. Maybe he DID send the payment and you just haven't received it. The correct thing to say is "he says he sent the payment but I have not received it".

Occasionally, mail DOES get lost. A check from Canada never made it to my house last year. Poor Buyer had to place stop-payment and start all over. She did, however, send proof of the first mailing. So, we cannot simply assume...

The Post Office does make major screw ups. I had second checks arrive the same day as the original "lost" check even though they were mailed weeks apart.
Unless a payment is for a substantial sum, I file NPBs 10-14 days after an auction--99% of the "mailed" checks that haven't arrived by that time will never show . Most all of the honest bidders get a clue and then send payment. The ones who don't respond are guaranteed deadbeats (I had one exception in 1300 transactions so that's a fluke). 10 days later I file for credit if the money is not in hand. While the 10 days to NPB-10 days more to FVF credit is short, it is a full six days longer than the two week norm and includes a wake-up call.
