Hi
I was searching for some items from my favorite coffee brand. I came across a seller auctioning off her/his own recipe for a well known cold coffee drink and using the brand name in the auction. Is this kosher??
I looked to see if this company was a VERO member, but I didn't see a "me" page listed.

Sure its all good companies and people were doing this long before online sales came along..
How many people remember The hellmanns product in the seventiy special sauce for makeing your own Bigmac sandwhiches at home.
How many have ever bought store brand mouth wash at the store on the label it say compare ours to "name brand X"

I guess....but it just didn't seem right that this well known coffee co would want to be associated with a "homemade brew"

Actually All Coffee is home brew it all Started at home...
Even apple computer and microsoft started at home..

In the '70's some woman was marketing cookbooks on all the morning talk shows. She had bought products like KFC, BigMac sauce, Oreo Cookies, White Castle hamburgers, etc., then in her kitchen she recreated the recipe. All in all, I think she had 10 cookbooks, and I bought 5. I never used them, I wonder if this would be a good thing to auction on ebay?
Not my name on ebay.

Valleygirl: I have listed one or two of those before and they sold for decent money ($5-$10) on eBay. I don't recall what time of year it was that I sold it. Hope it goes well. I have another in my personal cookbook stash and might be willing to get rid of it as I don't think I have ever used it. Hmmmm, might be a good item to put up today.

From something I was involved in a few years back, I came to understand that recipe's are not copyrightable. It was relevant to listing ingredients on food package sides (and in their order of most to least prominent in the product). The only time there is a problem is if you publish a recipe with the exact ingredients, proportions and instructions as another recipe that has been printed within X number of years of publishing... I can't remember the number of years. A lot of test kitchens that invent recipes (like Martha Stewart for example) start with other published recipes, and then alter the proportions, ingredients and instructions and print them as their own....

There is a website somewhere that has these as well. Top Secret Recipes or something like that.
Seems to me you should be able to mention another product -- like "Compare to Product X" -- using the name is not a violation of anything.

What is the difference to say "This Coffee Tastes like Starbucks" vs. "These Sunglases look like Oakleys"?
And we very well know what will happen if you say the latter.

I agree!
I would say "Compare the taste of our coffee to Starbuck's". I don't see that that would be a violation.
"Compare the look of our sunglasses to Oakley's" shouldn't as well.
