A while back I won an auction and paid via paypal. The item was damaged and I wrote the seller back and told him. I tried to make it easy and suggested he offer it to the second bidder, I would ship it etc, etc. He wrote back and said the second bidder did not want it and to send it back. Well you guessed it, he never credited me. Now all of this banter (can it be fixed, see if the second guy wants it...) took more than 60 days so I could not file a complaint through eBay insurance.
Well I just won another auction and it's the same seller with a new ID!!! Now what do I do???

I was going to neg him, but cannoty bring up the first item any more!
As to offering it to the second bidder, the item was expensive. Some people, for instance, will buy a cosmetic blemished wheel for $100 to put on their car after they bend their factory $800 alloy. - But not me. The item was servicible just not worth what I paid for it. (Damage was not described).
Oh. BTW. Before he changed IDs, he split the item into 2 component parts and sold them. (for less than I paid for the whole.)

I filed with Paypal a few weeks ago. I'll be willing to bet they come back and say there is no money in his account. The other thing that worries me is that if I hang around waiting for Paypal's decision, I might go beyond my CC "statute of limitations"! The rock and hard place routine.

I would remind the seller of the situation and see if he wants to make amends now. If not, try to come to an agreement no to go through with the purchase. Good luck.

I would file the chargeback DIRECTLY with the credit card that it ended up on, NOT through PayPal as their interests are in preserving only their financial well-being and not in the least bit in protecting yours!
