Ok here’s the situation.

The customer did not submit payment in a timely manner. I sent NPB warning then payment arrived 10 days later. She paid via personal check and even sent it with the auction page & invoice clearly stating we do not accept personal checks. Normally I have no problem accepting personal checks but she has 5 recent negatives out of 20. What should I do?

Just my personal opinion but I would not ship until the check cleared and this can sometimes take awhile. My bank has returned checks at times in 3 or 4 weeks. I would keep in touch with your bank to make sure it had cleared.

Then I would email her that her delivery will be delayed due to the fact that she sent a personal check even tho it was in your TOS that you did not accept them, so you have to wait until your bank clears it.

Of course, you can end it all by just sending the check back but it would seem since you already have it,that you may as well go ahead and see if it's good.

I would do one of two things:

Accept the check, call her bank see if the funds are there, then don't ship until you've called her bank again to make sure it's cleared. You'll need to scan and keep a copy of the check for this. Tell her you won't ship until her check actually clears and that this may be 7-14 working days or longer.

OR: Send her back the check, explain you don't take checks, but when you file for fvf's, choose the option that states buyer and seller agreed not to complete the transaction. I would get some kind of a receipt from the PO (either cert. of mailing, or a signature at her end) only because she sounds like a hassle.

Thanks Deco. I never understood why sellers say they hold checks for 10 days, you're right - my bank takes 3-4 weeks to clear a check. I have had many checks bounce after a month or so, then I get hit with an $8 fee.
Thus, I don't accept personal checks anymore.

I had this happen recently. I clearly state in my TOS that in order to pay via personal checks, your feedback must be 30+ with no negatives......my buyer paid by check, his feedback did not meet my requirements and on top of that his check was sent for an incorrect amount. I emailed him back and told him about my TOS and told him why my TOS are this way.......too many bad checks and returned check charges. I invited him to resend his correct amount via money order or cashiers check or told him he could pay via paypal. He choose to pay with paypal. His invoice did not include a paypal option as I don't include this option if I have met my credit card payment limit. I sent his item out promptly and had no problems.
