I recently bought some new jewelry from a seller with very good feedback. I paid a pretty good price and paid right away via paypal. The items arrived and were not as described, the stones were all falling out of the bracelets as i was opening them up at a show to resell them. she said all is guaranteed. I have emailed 2 times over a week and a half period and she will not respond. I have not given neg feedback and do want to resolve this. Can I complain to paypal? Is there a way to get a chargeback. I don't really care if she negs me as I've never had one and really don't think it would matter. I just want to get a response and resolve this.I don't even want a total refund, just to refund the defective merchandise, Any help would be appreciated.

The "ignore 'em until they go away" trick is old as the hills, and sounds like what happened here. If your seller intended to fix your problem, she would have done so by now.

If you funded this purchase with your credit card (as opposed to paypal funds), you can file a chargeback, but that will really irritate the fine folks at paypal. And, "quality of goods" chargebacks are not well-defined yet at Paypal, reference the infamous "PursePal" incident.

My vote is to file a fraud charge on eBay and work it that way.

You could always get their "contact" information from eBay. When you do this, the seller would be notified that you have done so and it may spur them into responding...

It's always possible that they are away right now. Do they have any current auctions right now? If they do then they are probably around, if they don't it may indicate that they have taken some time off...

There is a possibility, slim though it may be, that she's on vacation or something. Does she have auctions running right now?

I would send an email saying "Based on your FB record, it appears that in the past you have provided (excellent, very good -- choose one) customer service. I am very concerned that I've not heard from you in response to 2 earlier emails. Please respond by ________2001, or I will be forced to (contact PayPal, leave neg FB, whatever)."

BTW, what was the time lag between when you received the merchandise and when you contacted her the first time?

There are a few who don't care. I had one who finally was NARU'd last year, over a year after he cheated me. He had over 60 negatives and neutrals before he was NARU'd (he had over 1,000 postive feedbacks).

This was way before paypal so I paid by check, but he finally sent me cash. I wouldn't accept a personal check because he had a negative from another buyer saying his check bounced. I think he finally gave up and sent me my refund when he saw that I was relentless, another buyer was after him (we ganged up on him) and I didn't live very far from him

Sounds like chargeback is a good idea IMHO.

I am a seller, and I don't fear negatives. Why should I walk on pins and needles just to avoid a neg?

Of course I am referring to when I have done nothing wrong.
