i have been selling on ebay for about two months. i am a small time seller. just a hobby. ebay has recently cancelled my account because of excessive POTENTIAL infringing items posted. i received several warnings, but I never did anything wrong.
it seems like when i post software for sell, they shut me down, i dont sell cdrs and i dont also sell software thats installed in several pcs.
can anybody tell me how to get away from the ebay police?

Perhaps you could read eBay rules, pay attention to warnings when you get them, and that might keep you out of trouble.

My biggest piece of advice would be to save the original boxes and licenses for your software. If you have those, there should be no problem re-selling them.

Get this ...

I purchased an electronic thing from an eBay seller about a month and a half ago. When I received it, it didn't work. Seller refused to replace it, offer a refund, or even pay for repairs. Subsequently, I found out that a variation of this item (I'm trying very hard to be non-specific here!) is illegal and cannot be sold after April 28, 2000. I also found out the the seller has a bad rep with the manufacturer and he is not authorized to resell any of their products. What this means is that the "90 Day Manufacturer Warranty" that he includes in his listing is non-existant.

The seller has sold several of the illegal versions of this piece of equipment.

During the past month I have notified SafeHarbor 4 times about this seller who is selling illegal electronic items and misrepresenting warranty on the items. In my reports to eBay, I have included the listing ID's, quotes from the listings that prove the items are illegal, quotes from the listings that indicate there is a 90 day warranty offered by the manufacturer, a link to the Digital Millenium Copyright Act (Federal legislation) that describes why the items are illegal, a link to the manufacturer's site explaining why the product cannot be sold by anyone after April 28, 2000, and even the name and telephone number of the manufacturer so eBay can contact them to verify what I have been telling them.

Guess what eBay has done?

Absolutely nothing!

Last week I placed a bid on an item. When I was reviewing my bids list, I noticed that the seller won't ship outside the USA (I am in Canada). I retracted my bid (the only bid, so the auction outcome was not affected), explaining that I made an error and bid on a US only item. The seller contacted me and told me it was OK to bid anyway, but I found another similar item and used the BIN.

Today, I get an email from eBay telling me that my account has been suspended for 14 days for bid retraction!

Needless to say, I told them to cancel my account immediately and remove my CC number from their files.

I cannot believe this obvious double standard. Over the 3 months I was active on eBay, my positive FB was up over 70 with only 1 negative (I refused to send cash to a post office box and the seller ripped me with a nasty feedback - I didn't bother to retaliate).

Oh yeah ... the guy who is selling the illegal electronics? He currently has 19 active auctions for this stuff

Go figure eh ...

RB,
Maybe you should just buy and stop policing (sp) all of the sites. Just a thought. It appears to not do any good and hurts you in the long run. Personally, I am getting more sick of the ones who say, oh you can't do that because that would be against ebay's fee policy, blah, blah, blah.

That would be the "right" thing to do, but in this case, I was taken for over $300.00 US ($460.00 Canadian) by this seller and good old eBay will do nothing to either help me or prevent the seller from ripping off others

BUY FROM REPUTABLE DEALERS if it matters to you.
i just bot my ink cartridges from compusa.
stop whining and bitching buying on ebay from someone you dont know,you get what you deserve.
so quit whining.

I agree, I buy cartridges for my HP laserjet from... guess who... HP !!!
