I listed an item several months ago on eBay and got a check in payment. I got the check back marked "Insufficient Funds" about a month after the auction ended and the product was sent. I emailed the purchaser and let them know the situation. They emailed me back and said they would take care of it. Well, I haven't received the money to take care of the check and bank charges and they have just left a negative feedback! I'm assuming they wont be taking care of the check as they wont reply to my emails. What recourse do I have?? They live in Virginia and I'm in South Dakota. The check was only for around $10 (and another $20 or so in bank charges), but I want to pursue this to the end! This really has me peeved!

why not give him a call ?? It can be harder to be nasty on the phone then in e-mail.
other than that turn it over for collection you may not collect but they will anoy him and put a mark on his credit .
I had a guy stick me for 1300 once and he was out of state. In retrospect I wish I had flown out there and at least knocked on his door and let him tell me face to face that he was going to stick it to me .

If you deposited the check a month before you got the notification, you are likely protected by consumer banking laws. There is a time limit after which the check cannot be forced back onto your account, and it's far less than a month.
Ask your bank. Be insistent. Be persistent. If nothing else, they'll quickly offer to waive their $20 charge.

tiggressoflove - The town is Barhamsville in New Kent county. I did find a web page with the county offices and might try to contact a county sheriff or another office.

Roofguy, lots of people have been burned by checks coming back as much as a month after deposit. I have never heard of a time limit, can you give us any source or reference? Or perhaps a lurking banker can comment? Dave.

I had a check returned in a low dollar (less than $10) amount. Numerous promises from the buyer to make good proved false. After holding the check for another month, I called the bank to see if there were funds to cover. When that was confirmed, I re-deposited and this time it cleared. It didn't make up for the bank charges I incurred, but I did get my original money.

Thanks for the post about the collection agency. I have a couple of long overdue accounts for my consulting business that I just gave to them, figure I have nothing to lose.
