Hello,
I have a problem and I do not know who should I talk to about this problem, maybe you can help me. A mastercard holder placed an order on my website on 3/17/02 and used his credit card. The package has been delivered on 3/25/02 and he signed it himself.
I just checked my account and found out that he chargedback this transaction. I tried to call him, the phone# he gave me has been disconnected,I sent him an email, no respond. I tried to charge his credit card again for the amount he owe me but it needs 30 day approval, and I believe that he won't approve it because if he is a good man he won't chargeback his own transaction.

My question is, where should I turn in this matter to?

Hello anandasmom,

Is this through your own Merchant's account or was it through a 3rd party like PayPal or Billpoint?

This recently happened to me and when I was notified that I had a chargeback the bank required that I submit documentation of the website order. I also showed shipping info and I am waiting to hear back from them.

why does it require 30 days approaval??
you have no right to charge again just because he filed a chargeback.
who is your merchant account provider??
there is a chargeback feee with every chargeback,read the terms and find out if you have to pay if you win or just only if you lose.
if you charge him again,he will do another chargeback and you will be hit with another chargeback fee and possibly fraud.
your merchant account provider will explain to you what your rights are and how you can dispute it.

I am on the opposite side of this chargeback issue and am hoping for some insight on this subject. At the same time, I wholeheartedly wish the best for anandasmom, because it sounds as if you have been ripped off.

I made a purchase last week from a seller on eBay with his share of negative and neutral feedback; as a seller he had more than I would normally purchase from. He has about 3,000 positive, and a combination of about 120 negative and neutrals. Anyhow, he was selling a network hub that was described as such:

Product Condition: Product comes in retail box

Also in the auction is the statement that there is a 100% money back guarantee. I made a visit to his AuctionWatch store and saw some radios that I added to my purchase; the website said there is a discount of $5 when combining shipping.

Problem number one occurred almost immediately when I paid for the items (via my Visa, not through PayPal). The $5 shipping discount was shown as having been applied when I received an auto response e-mail. However, on the website invoice it showed I was charged $18.50 instead of $13.50. I notified the seller by e-mail of this right away and he said he would "look into it."

The package arrived via UPS yesterday. Thefirst thing I noticed was the invoice where it showed I was charged $18.50 for shipping. Then I got into the products. I tested the radios and they were fine. It was the network hub that I knew was going to be a problem after seeing the retail box covered with tape and a small Best Buy sticker on the side. I assumed at that point that it was probably a returned item. I opened it up and could tell the thing had been used by someone else previously. I could live with that, but I was worried about the reasoning for why it ended up on eBay. I immediately plugged the AC adapter into the hub and then into an outlet. Sure enough, it wouldn't power up. I tried different electrical outlets. I tried a different AC adapter that I had. Still no go. I sent an e-mail to the seller telling him that I am sending it back, and I filled out the return form that was included in the package. I mailed it back today.

My basic question (after my lengthy intro...sorry!) is: How much money should I expect to recover for this? I spent $18.50 on shipping (the radios were to ship for $8.50, the network hub for $10, minus $5 for combined shipping). I spent another $7.75 to send the thing back. Am I entitled to recover some or all of the shipping on a clearly defective product?

I want to be fair, and looking at this guy's history with unsatisfied customers, I don't anticipate him being very generous. I have had zero negative or neutral feedback comments in my four years on eBay. He's not afraid to give retaliatory feedback, and in this case I'm not afraid to receive it. If he isn't fair with his refund, I would consider a chargeback. But what would be the $$ I should try to recover?

did you return the radios??
it sounds like he is selling you a malfunction product and he knows it.
if you do a chargeback,he could produce the ups signature receipt and said everything was in good order when he sold the item to you,he could say not only did you mess up or switch on his merchandise,you also kept the radios.
why dont you call your cc company and ask what is the right approach ??
of course he could also said it was damaged in transit and make ups pay for it??
that shipping part of 5.00 is small feat compared to your server,i will get the server problem resolved first.

Thanks for the response, stopwhining.

I did keep the radios. I sent an e-mail to him right after I tried everything and told him that the radios were fine, but the network hub was not in working order (and I explained that I tried it out in many different ways). I felt I should keep the radios since they were in working order.

I've never done a chargeback, so I'm not sure what is required and what I am allowed. It wasn't done through PayPal, so maybe I have more leverage; I'm not sure. I've looked over the form on the back of my credit card statement.

In my defense, I think his record would speak for itself; some people are quite pleased, but there are others that clearly were not given working items or weren't given everything they thought they were supposed to receive. When I bid on the item I felt safer because of the "retail package" quote. In retrospect, that doesn't necessarily equate to "in working order".

I learned a lesson on this one. I will follow my instincts in the future instead of ignoring them.

how did you return the server?you may be asked to prove you have returned the merchandise like his signature receipt.
you cannot do chargeback until your statement comes,they usually have instructions on how you dispute items on that statement.
sounds like he is selling returns from bestbuy,you could make good money selling returns from good stores

I used Delivery Confirmation from the P.O. I had considered adding insurance, but I didn't want to add more $$ to my loss. Besides, it was already a broken item. I probably should have insured it in case it got lost, however. I have faith in the postal service that it will reach its destination.

I spent about $15 on the hub, and I paid an additional $10 to get it here and $7.75 to send it away!

Yes, I'm sure some of his items have to be coming from store returns. I couldn't in good conscience pass on things like that unless I checked to see if they were working first.

Did you use Verisign when you checked out on his auctionwatch store? If you did then the shipping discount will have been correctly billed to your credit card it just doesn't come up on the invoice correctly. The first step in check out is entering your address and credit card number, when you do this verisign confirms your address with the credit card provider. Then when you actually check out and the shipping discount is figured your card is billed for that amount. For some reason that neither Verisign nor AuctionWatch can provide it always shows the dollar amount on the auctionwatch invoice as the amount being billed before the shipping discount but invariably it is the correct amount after the shipping discount that really gets billed. I deal with this ALL the time! If it was indeed Verisign then you might want to call the credit card company and verify the actual dollar amount of the charge. Hope this helps!

Did you talk to him regarding the defective merchandise? I would think he would have said semnd it back and I will refund you such and such amount. Anyway the item received was defective. You should receive the price of the network adapter, and the cost of shipping paid both ways for that item. I have purchased from Ebayers with 2000+ positive and 200 neg or neutrals. I learned not to do it again! There is a reason for those negatives. I opened a seperate buyers account on Ebay, so when I purchase and the deal goes bad I can leave negs without effecting my seller account. I won't tolerate bad service from Ebay dealers. I want to be treated as I treat my customers

Yes, Dawndie, it was Verisign that I dealt with when I completed my purchase through the Auction Watch storefront. I will verify with my credit card company the total amount billed.

Mysticalcat, I filled in the return/refund form that was included with my order. I give the seller credit for that, although he probably had to resort to something like that based on all of the returns and complaints he gets. I also sent him an e-mail telling him what the problem was and that I am returning the item.

I wasn't sure if I was entitled to shipping reimbursement both directions. I will send him another e-mail and tell him exactly how much I expect to be refunded (the item, plus shipping both directions). Then, I guess if he doesn't send the correct credit, I will have to do a chargeback for the amount owed.

I, too, have a couple of user IDs on eBay (neither are "Palouse" because I wanted to use one for selling and one for buying (I seem to do a lot more buying than selling!!!).
