Seller sent me a widget that was smashed by UPS. I have contacted them several times and they told me to save the packing and they would send UPS to inspect etc. Each time I contact them it's "they'll get right back to me" etc. It is obvious nobody is doing anything about this. I filed for a chargeback from Paypal but of course 30 days had passed. If I contact the bank and do a chargeback, what will Paypal do?? Can they hit my bank account for the lost funds w/o approval??

You should have contacted UPS right away and started a claim for the damage. The claim is paid to the seller, so once it is approved, the seller should refund you immediately.

BTW, You can now file UPS claims directly from their web site.

As far as the chargeback goes, PayPal should eventually hit the seller's account for the lost funds.

If anything does come of it with PayPal, you can show proof of damage and that a UPS claim has been approved for reimbursement to the seller (UPS will actually send you an email to this effect).

Keep on UPS. They drag their feet when it comes to filing a claim. One correction however, they will not reimburse the seller (shipper). They send the insurance to the person receiving the parcel. I file claims for damaged item at work and it is up to you to follow through on it. The check goes to the cosignee.

I recently completed a claim with USP online via email. The whole process only took about 4 days and the last email I received stated the claim had been approved. The reimbursement was later paid to the shipper.

caffetalia, you are dead wrong about UPS dragging their feet. I have had to make 3 claims through UPS and have received payment within a week and a half each time. The claim and must be filed on the end where it was shipped and the check is mailed to the seller.

UPS asks that you keep the packaging for 5 business days after the claim is made. this is just in case they want to send a driver to look at it. This has never happened in the claims I had to file.

I have always taken a printed copy of the auction as proof of claim. They reimburse for the amount paid plus the shipping, so make that a part of your claim.

Good Luck to you. You should call a UPS office in your area and explain the difficulty you are having with the seller. they may have already received the payment and are just not forwarding it to you.

It's exactly like rarriffle says. I ship from eight to twenty packages by UPS daily. UPS is very fast in settling the claims I have submitted and have always reimbursed me the seller. I in turn send the customer a replacement for the damaged item.

UPS instructs that the customer hold the damaged item, package and packing material for five business days in case UPS wants to inspect the package and merchandise. After five business days they are told they can discard the damaged merchandise.

If the value is under $100.00 there seldom pick up the package for inspection but just send a check for the total to include shipping cost.

how much is that WIDGET??
ups only covers the first 100 dollars.
seller has to pay for anything over 100.

Thanks for the help all. My major worry had been if, in the fine print, Paypal could hit my bank account if my CC card company cancelled the charge.

Today brought 2 pieces of news:

1) Paypal refund from seller
2) Notice from UPS to have pkg ready for p/u after I filed claim.

I went to the UPS web site and filed the claim. (I had thought only seller could file it, but either party can.) When you do this UPS picks up the pkg for inspection but then forwards the claim paperwork, settlement decision, etc. to the shipper.

Lessons learned:

1) UPS will smash anything not cast in foam. (I knew this already)

2) Never let the process drag on for more than the 30 days. (I KNEW this already, but did it AGAIN.)

3) Never buy anything from big sellers with high fb whose negatives are all, "did not contact...", "no reply after.....", "no answer to my ...". If their business is too big for them to handle it, they should get out of it.

So, I got my money back and even though it was $275, I don't know if it was all worth the aggravation even with the widget being a steal.
