my friend purchased 2 toy cars over 3 months ago from a seller on ebay.
first of all the seller advised that he never send payment. so he emailed them advising the USPS is checking into mail fraud regarding the money order. the next day he said he received the money order!!!
now after 2-3 months he still does not have the cars and this was his response to the last email.

No different than selling pre-ordered items. I've seen people taking bids on DVDs/tapes, etc which haven't been released. And when they get them, they'll ship. Kind of like bidding on air.

I think you are supposed to disclose the fact that it is a presell auction if you are doing that. Not 100% sure though.

yip dont you love it he gets the money 3 months ago also he filed a NPB report aswel which has since been removed.
petpost would you be happy if you purchased say a new tv and were still waiting after 3 months even though the seller had your cash.....

Yes, you are allowed to sell something you don't have yet, but according to ebay rules you MUST state this in the auction.

I haven't seen anyone post that in their auction, but I'm sure there are some who do. I paid for an item immediately only to be put off, and put off, and ignored until the item finally arrived, and then was shipped to me. I wish they had stated in their ad that they were going to order the items AFTER the auction was over, and process them for shipping.

it is VERY COMMON PRACTICE on ebay and yahoo,sell what you dont have-no matter how you slice it,call it drop shipping or presale,the seller just does not have the goods.
on amzn they require you to have the good on hand before you list.

There's some JIT businesses on eBay that sometimes find their inventory doesn't arrive quite JIT. I'd imagine they make eBay enough money to be overlooked for the occasional slip up.

update my friend left a negative because no sign of toy cars and he left neg back typical however he is more than happy to make others aware of the poor service offer.

That could be considered a threat. I would contact eBay on it.
As far as presales, the item must be able to be shipped within 30 days of auction end, and state that it is a presale in the auction.

According to that link, his auction was a violation of eBay policy on pre-sales. They might remove the neg based on that violation.
It couldn't hurt to try. Also include a copy of the nasty e-mail

yeah this was his response to a negative feedback that was left because payment was made in 1 day item still not shipped after 3 months....appears they sell an item take the money then go looking for it!

Send a copy of the dirty response to Ebay. This is a NO NO. I had a customer call me an A--hole because her piece of china got broken in the mail. It was insured & she refused to go to the PO. I told her I couldn't do anything until she filed a claim. Left me a neg fdbck as well. I sent it to Ebay & they reprimanded her for the foul language.
