This is the second time this has happened in the last couple of months. I buy something and it arrives damaged. In both cases I am 99% sure it was shipped already damaged. I mostly sell on Ebay and the stuff I ship never gets broken in the mail. It's getting so I am afraid to buy. (tooterville on Ebay)

This time it is a cruet with a hob broken off. There is no glass in the box so I think it was sent damaged. I contacted the seller and he won't send the insurance papers, he wants me to ship it to him and have him file the claim. What do I do if he denies the cruet is his and won't return the cruet? This is going to cost me shipping along with a big fat unnecessary headache.

Also, do I have any recourse because I paid with PayPal?

He has to file the claim from his end, because he has the insurance receipt. Do not send the item back to him. In turn the PO will send you a paper also to file where they ask you for a copy of your payment, and then I think you have to take the packaging and item to the PO for an inspection to see if it had been packed properly. If they determine that it is their fault you will get your money back. But, if it is the Sellers fault the seller is responsible. I hope this helps

He says I have to send him back the cruet so he can determine if it is his. Of course it is his! So because he sent me a damaged piece of glass, I will be out the shipping back to him. Then I cool my heels while he determines if it is his and then if I am lucky he files an insurance claim.

Do you know if it is possible to file with my local post office without the insurance forms if I take in the auction printout, emails, box, packing and cruet?

How was it mailed??? usps, ups, fed-x ??

Did the box that the cruet was mailed in, have a stamp on the outside saying "insurance"...shiped threw USPS.If it did, then do not send the item back to the seller....

If the box has no insurance stamp, that would mean, he didn't purchase it threw the USPS when he shiped it.

Did you purchase insurance when you paid for the cruet??, just asking.

BULL, CRUET SOUNDS TO ME LIKE SOME VERY SMALL ITEM. WHAT IF IT WERE A T.V. SET. AS IN "BIG". GO TO THE POST OFFICE WITH THE POSTAGE STICKERS AND ALL PERTINENTS. THEY WILL SEND "HIM" THE PROPER PAPERS FOR "HIM" TO FILL OUT. WHERE DOES HE GET OFF,,,,,,SEND IT BACK FOR "HIS" INSPECTION. YOU ARE DEALING WITH A DEAD BEAT. HE MAY NOT EVEN REPLY TO THE POST OFFICE PAPERS. GOT ONE OF THESE CLAIMS FROM A GUY ONCE. TONS OF PAPERS. I IGNORED ALL OFFICIAL NOTICES AND JUST SENT THE KID $20.00. NEVER HEARD NOTHING BACK FROM THE OFFICIAL GOVERNMENT. CAN'T GET BLOOD OUT OF A TURNUP. IF HE IS FOR REAL, WEEKS FOR THE POST OFFICE.

I checked the box and it does have the insurance sticker. It was shipped USPS. $60 plus S&I is a big deal to me. That is why I hate to have to spend more S&I to send it back to the seller. Plus all the time it wastes. I will take it up to the post office in the morning and show it to the postmaster. I wish now I didn't joke around with him all the time. He might not take me too seriously this time! Wish me luck!

Yes, by all means take the box and contents to the PO. Someone will inspect it there. With $60.00 insurance on it there is a tracking number. Is the ticket blue with numbers? I think you can fill out the papers and then they will send your seller his papers to fill out.

THERE IS NO LUCK HERE. YOU HAVE THE INSURANCE STICKER.

BE ADVISED IF YOU ARE A SELLER AND YOU FILE WHAT UPS CONSIDERS AN EXCESSIVE AMOUNT OF CLAIMS THEY "WILL" FIND WAYS TO DENY YOUR CLAIM. MY LAST ONE, "USED BOX". CLAIM DENIED. WHAT A JOKE. BUT, IT WORKED THEY NEVER PAID THE CLAIM. I FEEL THEY HAVE A CAP WITHIN A CERTAIN TIME FRAME. THEN YOU GET TO START OVER AGAIN. TILL THAT CAP IS MET AGAIN. WHEN YA SHIP ALOT, YOU KNOW WHAT CAN HAPPEN .

I MAY BE RIGHT,,,,,,,,AND I MAY BE WRONG. TRACKING IS AN EXTRA CHARGE? I THINK IT IS. BUT,,,,,,,WHAT DO I KNOW?

There is an insurance sticker with a blue stripe across the top. There is a bar code across the bottom. I have never filed for reimbursement before. I don't know if the seller has or not. He is a "power seller" and has very high positives. I skimmed through a few pages of his feedback and did find that he has a few people unhappy with the condition of their items. Can't tell if he made it right or not.

whatever you DO NOT send it back. Tack it to the post office and show them the damage. they will lead you from there. If the seller refuses at all to help then file for a chargeback on your credit card. Don't let him bully and boss you around into having no product for proof and no money.

kasue-That blue insurance slip is probably all you would need to prove you have insurance. It is tracked internally so you can't do it on their website, but they can. Keep us posted

also if you have digital camera take pictures, send him pic instead of item
and ask him it is his.
BCC yours self on the email
so you have proof that you sent it,
ask for receipt of readining (in your email settings)

paypal doesnt get involved in the quality of merchandise the best and quickest option is to chargeback your credit card however before doing this ensure your paypal account is EMPTY as it will get restricted.

PayPal will not help on a Quality of Goods Issue, so there is not much help there.

is the cruet worth 60 dollars??
if he sends you the insurance slip,the form signed,you may still be denied by the post office if they cannot find the broken part inside the box.
they can also deny you if they think it is not worth 60 dollars,especially if all you have is an ebay end of auction final bid price.
how did you pay him?? paypal fund or credit card via paypal??
