I wrote last week about a Dutch Auction

where the seller claims that ALL the hoses were shipped out and lost in the US Mail

All bidders got a email Saturday night from Ms. Layton saying she was from the Post Office working with Eric using a HOTMAIL address, that sent up the red flares.

Thank You for your help. He had another auction for hoses posted but Ebay closed him down, he is now unregistered using this name.

I figure he claims 230 hoses at a cost of $10.95 per hose and $6.50 shipping ($9.50 for first hose and $6.50 additional so benefit of doubt here) is $4013.50 for this auction.

Now we are waiting another 10 days to see if Paypal will refund our money. There is quite a group of us filing claims with Paypal. I bought 5 hoses and paid $90.

Many people paid check or money order and many only got 1 or 2 hoses so ANY suggestions offered for these folks would be apperciated.

These bidders are keeping each other informed which is great. I think I counted 62 bidders involved in this scam.

When I filed a claim against thebarry when he ran off with my $120.00, paypal told me there is nothing they can do about it, if he is NARU'ed, and if his paypal account is empty UNLESS payment was done vis Credit Card, then you can dispute the charges, and then you can get your money back. hope this info helps!

well im sorry i dont mean to be the pessimist, but unless you paid by cc than you are pretty much crap out of luck. i filed everything under the sun against a seller but nothing ever came of that except 2 naru'd ids and a suspened pp account. not mine of course. so i wouldnt hold my breath. =/

You know the post office can really prosecute this guy. Did you ever call the 800 number for the USPS about the supposedly postal employee emailing you via hotmail????

Did you use a credit card to pay this person via paypal?

hopefully you used a credit card if so dispute the charge with your credit card company...however please ensure you EMPTY your account prior to doing this as it is likely paypal will lock up any funds you may have in there.

Thanks again for your help.

It will be interesting to see how Paypal handles this. There are many bidders from this Dutch auction that have filed for refund.

I am so glad I did use my credit card for this auction. Will Paypal freeze my account if I do a charge back with my credit card? My friends and family tease me about buying so much on the auctions. I used to say "Ebay should ban me so I will quit spending money there."

Oh well I met some great people in the auctions and had fun. The sellers sold before me and they will keep on selling! I liked using Paypal because it made things so fast and USUALLY I got my treasures within a weeks time. Snail mail the check is like going back to early 1900's.

more than likely yes paypal will freeze your account so best to empty any balance you have

Hi sandraj,

Your account will not be restricted because you filed a buyer complaint first (before filing a chargeback).

***The only disclaimers I would have that could be applied in general relative to restrictions from chargebacks***

1. It could happen if you filed a merchandise quality chargeback and kept the merchandise without returning it to the seller.
2. You did not file a complaint first.
3. The seller refuted your claim by showing shipping proof to you (delivery confirmation,etc.).

I do have to remind that our Buyer Complaint Process DOES NOT guarantee recovery from a seller you have had an issue with.

damon just clearly stated that if there are no funds you will get no money back...do you think this person will have funds for you???

i would empty account and file chargeback seems like the only LOGICAL way to get money back?

Thank you Damon. I will pass this info on to the other 62 bidders, which I am sure more than half used Paypal.

Be prepared for some good stories, we all heard from Ms. Layton on Sat. night from the US Postal Service using a Hotmail address, the gov email must have been shut down for the weekend. Many of us wrote back asking for a phone number and ID number so we could call her but of course none of us heard back from her.

I hope you froze Eric's Paypal account by Sunday when you started getting all these claims. I figure he made over $4,000 claiming 230 hoses were "lost". I know all aren't Paypal but I am hearing from bidders themselves that are Paypal.

Maybe Eric will get a "Pardon" from President Bush viva HOTMAIL.

I have to disagree with you Damon. I filed a complaint on a seller that I paid through Paypal. The complaint came back in my favor but since the seller had no money in his account, I got no money. I then disputed the charge with my credit card. A few months later, Paypal closed my account. This is what it says on why it was restricted:
Account Restriction Details

PayPal is constantly working to ensure security by regularly screening the accounts in our system. During a recent screening, your account was flagged for further review. We apologize for the inconvenience. Our screenings are designed to protect our payment network, but we realize that they sometimes flag the accounts of members in good standing. Thank you for your patience.

Why is my account restricted?

Your account has been restricted because you initiated a payment reversal ("chargeback" through your card's issuing bank on a payment made using PayPal.

PayPal's User Agreement outlines the policy for our internal Buyer Protection Program, which we provide to internally resolve disputes between buyers and sellers. When you choose to use an external chargeback program instead, we will honor a chargeback that our investigation determines is valid. However, as per the User Agreement, we reserve the right to permanently restrict your account.

After the chargeback investigation, we will forward any funds remaining in your account to your address on record.

This was sent to me and now several bidders from our "Dutch auction group" are filing.
Just trying to stop fraud

Just got off the phone with the Salt Lake FBI and here's the gist of the conversation. Alone the FBI will not take a complaint; not enough money involved. But, if everyone will go to the FBI site www.ifcc.fbi.gov , fill out a two minute form, it will appear to the duty officer that we have enough money and/or persons involved for them to get involved and investigate. Either they will prosecute or they'll forward it to the Utah State Police. If for some reason this link doesn't work, go to the FBI's main site at www.fbi.gov and click on the internet fraud link. The person was very helpful and felt that we had enough people involved to get some action.

"Thanks and Good Luck"!!


Sounds very repudable(sic)to me and buyers will certainly need "Good Luck"

Hopefully, there is still a balance in the PayPal account. If there is, then you should be able to get it back. If not, hopefully you paid with a credit card.

Hard to believe that he had a 1000 hoses.

tell the FBI that eric was recruiting fellow terrorists and intended to HOSE DOWN the whole country.
