Whenever a buyer gets ripped off, ebay stresses that they do not get involved in transactions, that they are just a venue.

Then they promote SquareTrade to resolve the situation.

ebay is getting paid by the sellers so perhaps they don't really care about buyers all that much. Some buyers may decide not to return to the site but in the meantime how many more sellers have jumped on board and how many more buyers?

How many sellers actually buy on ebay? I do and it is sometimes an eye-opener but I have had good dealings for the most part. My buying experiences have made me a better seller.

I buy on ebay for my sales, collections and for friends...the few times I have been disappointed were because I bid too quickly without looking close at the item but I have never felt ripped off by a buyer.

I always check a sellers feedback before I bid and feel that one step has helped choose sellers that can be trusted.

there have been quite a few sellers that, after looking at the feedback or TOS, I have chosen to hit the back button without bidding.

O.K. GOOD MORNING!

RARRIFFLE,,,,,,NO SO THE CASE HERE I HAVE LEARNED WAAAY TOO MUCH RIGHT HERE FROM EVERYONE TO HAVE BID TOO FAST OR NOT READ OR NOT E MAILED THE SELLER IN ADVANCE AND FINE TOOTH COMBED HIM.

I HAVE NEVER BOUGHT A N Y THING ON E BAY BEFORE. SO I WAS MOST DILEGENT IN CHECKING e v e r y t h i n g OUT. SEND ME A WORKING UNIT WAS MY FIRST WORDS TO THE SELLER. THERE WERE A FEW E MAILS BEFORE I LAID MY MONEY DOWN. (AND STUPIDLY DID "NOT" USE A CREDIT CARD!) I PAY PALED THE MONEY. IT GOT HERE OVER NIGHT. COOL,,,I OPEN THE BOX,,,,A BRAND NEW FACTORY SEALED UNIT. OPEN IT, JUNK! DEFECTIVE.

I E MAIL THE SELLER,SEND IT IN FOR WARRANTY HE SAYS,,,WHAT!!!!! THIS THING IS 5 MIN. OLD!!!! I WILL SEND THIS BACK TO YOU, YOU SEND ME A WORKING UNIT,,,,SORRY, WE CAN'T DO THAT,,,,ACTS LIKE HE IS SOME BIG COMPANY. HE CAN DO ANYTHING HE DOES OR DOES NOT WANT TO. PAY PAL PROTECTION IS A JOKE, I SPOKE WITH THEM. (THE ONLY PROTECTION THERE IS AFTER WHAT I HAVE GONE THROUGH IS USE A "CREDIT" CARD SO YOU CAN DO A CHARGE BACK).

JUST LAST NIGHT I PAY PALED HIM A BILL FOR $36.00. HE IS LOCAL. MY MESSAGE ON THE PAY PAL WAS, TAKE UP MY DISPUTE UP WITH SAFE HARBOR YOU SAY? YER JOKING. I WILL TAKE THIS UP WITH THE LOCAL COURT HOUSE AND THAT IS EXACTLY WHERE I WILL SEE YOU.

HE THINKS HIDING BEHIND THE INTERNET IS GOING TO PROECT HIM. WE ARE BOTH IN CALIFORNIA, 10 MILES APART,AT LEAST I WAS THINKING AHEAD WHEN I DECIDED TO BUY THIS PRODUCT AND GOT IT FROM A LOCAL SELLER. IF NOTHING ELSE, IN THIS STATE THERE IS A 3 DAYS BUYERS REMORSE LAW. I NOTIFIED HIM THE DAY I GOT IT.

MY OPENING STATEMENT AT THE TOP WAS THE REPLY I GOT BACK FROM [email protected] E BAY IS ON THE SIDE OF THE SELLER.(HAHAHA, WHICH IS WONDERFUL NEWS FOR US AS A SELLER, I WILL NEVER BUY ON E BAY AGAIN. COUNT ON THAT. TWO SIDED SWORD BUT I LEARNED) WE AS SELLERS PAY THE BILLS NOT THE BUYERS. WHEN PS@EB READ MY E MAIL THEY ASSUMED "I" WAS THE SELLER AND GAVE ME ALL KINDS OF ADVICE HOW TO SCREW WITH THE BUYER! HAHAHAHA.

THERE HAVE BEEN SOME THIRTY BUYERS WHO HAVE THREATENED THE HELL OUT OF ME IN 2 1/2 YEARS,,,,THEY ARE GOING TO TAKE ME TO E BAY AND THIS AND THAT. THAT WAS BEFORE THEY EVEN EXPLAINED WHATEVER THE PROBLEM WAS. WHAT A JOKE. NOW I SEE WHAT E BAYS REPLIES ARE TO A BUYER. WHATEVER THE SELLER WANTS TO DO IS 100% UP TO HIM. WE DO NOT GET INVOLVED WE ARE JUST A VENUE.

BTW,,,,I HAVE REFUNDED "EVERY" PERSON WHO WAS NOT HAPPY IF A PRODUCT WAS DEFECTIVE AND FOR MANY OTHER REASONS ALSO. (UNLESS THEY WERE STUPID AND JUST HIT THE DREADED NEGATIVE BUTTON FIRST.)

Jack,

You should be able to file a complaint with Ebay and get some money from their insurance. They will give you up to $200 minus $25 deductible on any claim they approve. You file a complaint with Ebay. The seller has a chance to make it right or Ebay investigates and decides who is at fault. If they agree the seller is at fault, you can then file for a payment through their insurance. As long as both you and the seller were in good standing at the time of the transaction.

Per Ebay, a complaint can be filed:
If you sent the money in good faith to the seller and never received the item. Or, the item you received is significantly different from the seller's description.

An item that does not work would be significantly different than the description.

I have also heard of people doing a charge back through their bank.

As you have found out the hard way, ALWAYS change your payment option on Paypal from checking to your credit card so that you can charge the item back if the seller does not follow through.

I forgot to add that Paypal defaults all payments to your checking account so changing it once does not fix it permanently. I would have been out over $1200 on a deal had I not noticed they were using my checking account and changed it. I was able to charge the amount back to my credit card.

OH! I DID READ HIS FEEDBACK NEGS,,,MOSTLY FROM THOSE WHO NEVER READ HIS $12.00 SHIPPING FEES FOR A $3.95 POSTAGE. THAT DID NOT BOTHER ME. IT'S CALLED SHIPPING AND HANDLING AND I UNDERSTAND THAT. OVERALL HE SEEMED O.K. YEAH,,,,,HAHAHAHA. UNTIL YOU DEAL WITH HIM.

HE IS VERY AWARE THAT HE SELLS PIG IN A POKE STUFF. SOME GOOD, SOME BAD. I JUST HAPPEN TO GET,,,,,THE BAD ONE. CRAPPY BUSINESS PRACTICES. HE WILL SEE ME IN COURT, I WILL FILE ON HIM.

HE SEEMS TO THINK BECAUSE THIS IS E BAY HE IS EXEMPT FROM LOCAL LEGAL ACTION. BEEN IN COURT BEFORE FOR THE SAME KIND OF THINGS BEFORE. WHEN THE HAMMER FELL,,,,THE DEFENDANT PAID. I COLLECT.

20 MIN. DRIVE THE COURTHOUSE. LESS TIME THAN DEALING WITH E BAY AND ALL THE DEFENDING THE SELLER STUFF THEY WILL DO. THEY ALREADY EXPALINED THAT. THEY PROTECT SELLERS, NOT BUYERS. WE AS SELLERS PAY THE BILLS, BUYERS MEAN ZILTCH TO E BAY. THE DOUBLE EDGED SWORD.

You are 100% right. Take the #@!* to court. Please keep us posted on the outcome. Oh, and the local media would probably looove an eBay rip-off story. Just a thought.

How did you get ripped off since it is a factory sealed unit with a warranty? The seller had no way of knowing if it was defective or not.

Did the seller offer a return guarantee in the listing? I think you are trying to rip the seller off. You bought it without a return guarantee and probably paid a lower price in exchange for this risk, now you want to force the seller to take it back. What a joker you are. You can't fool us all Jack. Your game is exposed. It's a nice scam you are trying to pull off Jack. That's why ebay or paypal doesn't get involved in cases like this, it's the buyer doing the scamming.

QUICKDRAW,,,,EXCUSE ME,,,,ONCE I INFORMED THE SELLER OF THE DEFECT, IT SEEMED TO BE A SIMPLE SEND IT BACK AND IN RETURN GET A WORKING UNIT. WHERE IS ANY "SCAM" ON MY END?

WHAT "GAME" IS EXPOSED?

I E MAILED THIS GUY THREE TIMES BEFORE I EVER PURCHASED. I WAS PESRSONALLY ASSURED EVERY THING WOULD BE AS REPRESENTED.

What's stopping you from returining it to the manufacturer?

Maybe the seller is concerned you're doing a switch. Stores have various policies about returns, and you just happen to be creating your own policy to use with this seller. Why didn't you ask before bidding what can be done if the item is defective? Did you pay a lower price than norm because the seller doesn't have a guarantee?

You were assured everything would be working? How does the seller know since it is factory sealed? He knows it is brand new and chances are it would be working, that's it.

I have nothing personal against you despite how I phrased my comments. I have this thing against buyers who whine when it is them who caused a problem for themselves. That's it.

WHAT'S STOPPING ME FROM RETURNING IT TO THE MANUFACTURE? TIME! THIS IS NOT SOME DUSTER TO SIT ON A SHELF, THIS IS A COMPONENT TO MAKE MY COMPUTER DO SOMETHING I REALLY WANTED DONE LAST WEEK.

I PAID THE PRICE THAT WAS IN HIS AUCTION.

I AM NOT INTO ANY SWITCH WASTE OF TIMES GAMES. I WANT TO GET TO WORK AND IF THIS DEVICE HAD OF WORKED THAT'S EXACTLY WHAT I WOULD BE DOING.

I WILL JUST FIND ONE IN A REAL STORE AROUND HERE AND GET TO WORK.

Generally this only applies to door to door sales unless California inserted additional clauses, it is highly unlikely though.


If the seller doesn't have a return policy posted they do have to take a return for defective items. There may be some limitations. Check further with an attorney.

Ebay is an auction where items are usually cheaper than retail units. Unless the seller had a money back quarantee stated in his auction description than there is a definite element of risk. Even the sellers that do offer money back guarantees often make the buyer pay for the return shipping and that can add up and cut into the bargain aspect of the original deal.
If it's a new item available at local stores the buyers are also better offer buying it there instead of at ebay because of the chance that it may be defective and can be easily return for replacement or refund. Local stores have many advantages over ebay.
