Hi everyone,
I won an item on Ebay on Set. 20 which happened to be a live plant. I paid by personal check because the seller stated that the item would ship right away even with a personal check as long as your feedback is a certain number (which I have). I sent the check the next day. The check cleared the bank on Oct. 3. The plant never came. I waited and waited and finally decided to email, which I did much too late. The seller's daughter wrote me back telling me that her Mother was in bed with a serious back problem and needs surgery, but they do not have insurance. Since it is a live plant, I am afraid by now it probably is not in the same condition as when the auction was over. Considering this lady is sick, would it be rude to ask for a refund? I would like to hear opinions.

Hmmm...If the seller ships "right away" even with a personal check, it seems odd that she was healthy enough to deposit the check, but not well enough to do her shipping.
Did she buy anything, list anything, or have any auctions close after September 30th? (I'm assuming that she deposited your check around that time, but you could look at the back of the check for the date.) How has her feedback been lately--any positives since the 3rd? If you're being scammed, you'll probably find some discrepancies in these things.
I had another eBay member e-mail me one time because she got jerked around by the same seller I did. If you see any feedback from this month, you might want to e-mail the person (whether it's a buyer or seller) and ask if they were told about her illness.
If you can clearly see that you're NOT being scammed, I guess you just have to decide for yourself (depending on the amount involved) whether you want to press for a refund or can afford to chalk it up to bad luck.

Business is business, a deal is a deal. If the daughter can type & send emails she can put stuff in a box and take it to the PO. Write a nice email reminding the daughter that a deal is a deal and you want your plant or your money back ASAP. Oh, and your sorry her mom is ill and you hope she'll be ok, blah, blah, etc, etc.
