I received a bad check back from the bank on 2/4 and have written to the buyer 2 times and have had no reply. Can I go ahead and file for an FVF now? I don't know if there is the reason for filing "bad check" on the list or if I should use "payment not received". This is the first time in 3 years I have gotten a bad check and not had the buyer make it good immediately.

I believe there is a Bounced check.

Yes, a bounced check is one of the reasons given on the list for filing for FVF. Do us a favor and copy and paste the copy of the email you get from Ebay and post it over in this thread. I'm just curious if it's the same canned warning they send on regular NPB alerts or different for bad checks. I've never had a chance to see one.

After 3 NSF etc. checks in a year, I WILL not take a personal check. To Hezz with these peop[le, thwere are severqal ways to pay besides by personal check. Why should I worry whether the check is good? I will gladly pay the fee to P/P & have the $$$.

Heres a link for bad checks that I book marked in case I ever got one even though I don't take checks...you always get 2 or 3 a year ,you know the ones that can't read

I am so mad! I just tried to file the NPB and it refused me. I figured out I was 1 day late. That's what I get for being a nice guy and waiting to hear from the "bad check writer". Guess I'll just leave a neg and next time try to keep better track of the time. Sorry Sparkz.

Mommoo...If you live in California, you can file suit in small claims court. If they don't show, you will get a default judgement for the amount of the check PLUS triple damages (minimum $100.00, Maximum $500.00). So if the check was for $100.00, you would get judgement for $400.00. Then click on the link above posted by toasted (hey! that has a ring to it - posted by toasted). I would contact the Mad collection agency and turn them loose on the deadbeat. Actually, they're not a deadbeat. Many states call rubber check artists thieves.

Use the MAD online collection agency. No fees and it works. Only one bad check in over 1,000 personal checks and MAD collected the money for it in about a month's time.

Try mailing a letter. If he's having money problems he may not be paying his ISP.

I'm sorry but your check for $XX.XX0 bounced. This was for an ==ITEM== from EBay.

I certainly understand that we all can make mistakes from time to time and should not be heavily penalized for these simple human errors.

Would you be so kind to send a money order in the amount of $XX.XX (the amount of the check plus the $6 my bank charged me) and I can close out this matter with no further action.

Please respond right away so that I am not forced to take further action. You costs will increase substantially at that point.

how much is the amount?
you may try to call the bank and identify yourself as a merchant,and ask if there is enough fund to cover the check ?
if there is,then try deposit it again.

Ah, something I know something about: the California bad check law.

sparkz is essentially correct but there is more to it than that. There are procedures you must follow to have a valid claim.

I have a link to a form you can use but it's on a different computer. I'll rustle it up. California sellers, you want to bookmark this for future reference even if you don't think you need it now.

Remember, most people know or should know that they bounced a check. If they did not contact you, already they have broken faith. I'm always quick to point that out as well as pointing out the potential remedies available to me, the aggrieved party.

Here it is. You only have to fill in the blanks and mail it certified return receipt requested.

(You can also put all this in a letter but this is so much easier.)
