I have over 30 auctions ending in 2 hours. They have all been bid on by the same person.

I have written to them to double check they really placed the bids and that it is not a hijacked account, but have not heard back yet.

EBay cancelled 2 sales last week for the very same reason.

Any advice? Please.

I don't know - I bid on one of your scarves (would make a nice xmas gift) and outbid that person - looks like he/she has 5 cent maximum bid. I wonder if they understand that shipping is NOT COMBINED ??? There is a sentence in your TOS that is kind of confusing. Maybe he/she is a bottomfeeder?

Well how did it turn out? they respond if you let auctions finish? or did you go in and cancel their bids and add the to your blocked bidder list. What a hassel...

She is for real and lives in Colorado Springs and so do I. She thought she could just come pick them up and there would be no shipping or handling charges.

Last EM she wants me to mail them but reduce s/h because we live in the same city. Oh and add on insurance.

It's a shame. I offered for her to come pick them up and I would reduce the total by 20% if she paid cash. No deal - wants them mailed.

Some get it - some don't and I have gotten burned trying to educate them.

So it didn't go as smooothly as I thought (or hoped). After filing and concluding the FVF routine, and her being suspended she paid today with a note saying her attorney will contact me after the New Year.

She has threatend negative feedback which I reported to eBay but that part is the least of the problem.

My question is, can I refuse to ship to her if I fully refund? I have never gotten so far into a problem before. The total is over $100.00. I really want to let it go, and I have an attrney too but that route can be messy and prolonged.

If you really think she'll go the attorney route, I think you should ship and follow everything to the letter.

Sorry - you are in control and don't let anyone tell you differently. You can refuse to sell to someone - refund their payment and explain that because they have not followed your Terms of Sale within the time prescribed by eBay - you have decided not to sell the items to them -- and sell them to someone who can read and follow directions.

If you end up complying with this miscreant - please don't tell us because we really don't want to hear how a customer can set your terms for you. Remember - there's a sig file someone here uses -- that says you should bend over backwards to please a customer -- not forward...!

No, scratch that.

People often threaten lawyers, but they never follow through. Forget the threats. No lawyer wants to get involved in this kind of a dispute where there is no contract involved and where the players have little at stake.

You are entirely within your rights to refund and cancel all transactions. That's what I would do.

If eBay suspended her, she had already been a burr under the saddles of two other sellers.

I would refund and not ship - if she mailed a check or money order, mail it back to her registered mail, signature required, so that she can't later accuse you of keeping her payment.

Don't worry about attorney - she doesn't have a case. She attempted to change the terms of the contract - you made a counteroffer which she didn't accept - the term of the offer expired. Now her payment constitutes a new offer, and if you send it back to her, it is a refusal of her new offer, therefore, no contract exists.

You refused to meet my terms of service for the above-mentioned auctions. I have followed the appropriate process with eBay to end the transactions based upon your refusal.

Your payment is being returned to you immediately and I consider this the end of the matter. Any further communication from you will be considered harrassment and will be reported as such.

yippee! go with fleecies approach.

i've used a similar phrase to fleecies, about harrassment. it has never failed to work. people who threaten you are cowards; they'll move on when they read something like that.

I would not ship to her, and definitely refund her money. Since she was NARU'd I believe she won't be able to leave negative feedback. Do not reverse the FVF, just refund her and be done. Don't worry about a lawyer, as others have said, many say this, very few do anything about it. Also, what exactly are the possible damages? If it is nondelivery of product, you are within your rights via the agreement with ebay, as you went through the process they set up. Payment was due within a certain amount of time, otherwise you have the right to not fulfil the transaction. Maybe she can sue ebay if she thinks that the NPB process is flawed, but you are not in the loop. Maybe it ought to be against the law to threaten someone with getting a lawyer and not following through, maybe it is (harassment) Anyway, good luck!

She paid. Yes late. Yes after the FVF's have been done, but who cares? The whole purpose of a seller is to sell. Take the money, ship the items, be sure to send it signature confirmation and move on. If you do that, no court in the land will even hear the case.
