Never responded, a dispute was opened, finally paid pay pal, I shipped the item.

He immediately starts contacting me to close the dispute it is paid. I wait for the arrival with D confirmation, all is Ok.

Now 4 days after receiving with the DC he has a packing issue with the merchandise?

He is still after me to close the dispute and I just told him to return the item for a refund. Please note prior feed back indicates he hassels people on shipping.

Am I out of line on this for not closing the dispute earlier? any suggestions?

If the dispute was for not paying and he has paid I think you should have closed the dispute when you recieved the payment.

I also think you should have closed the dispute the moment you received the payment. The dispute was for "non payment" and does not have anything to do with it being delivered, if it arrived in one piece or if the buyer is happy with it.

Yeah - it's only about payment so you should close it.

OTOH, if he returns it for refund, and you closed the dispute for non-payment, you will NOT get your FVF back because you can no longer do a mutual agreement to terminate transaction.

I'd keep the dispute open until the transaction is done.

Well he didn't contact you so turnabout is fair play ( no response from you yet ) but yes it should have been closed. He may neg you anyway just be prepared for a response to his neg. Tell me you have not left him feedback yet..

Let it be. The dispute means absolutely nothing until you either cancel it or file for your fees back. If you do nothing, it will cancel automatically after 90 days. Patience my friend.

I agree with cash on this one. The closing dispute options are:

We've completed the transaction and we're both satisfied. (Obviously, this isn't the case as the buyer is still unsatisfied.)

The second one doesn't apply in this situation.

and

We've agreed not to complete the transaction or the buyer is returning the item. (This may be the correct one to choose as the buyer may end up sending it back. If so, then leads can get his FVF back and relist.)

Hold off on closing it, leads, until the buyer decides what he's going to do. Explain to the buyer that although the dispute remains open, he won't receive a strike against his account as he did pay. However, because the transaction isn't fully completed just yet because he isn't satisfied, then in order for you to receive your fees back, the dispute must remain open.

Just my 2 cents ...

If the person returns the item and you want to get your FVF from ebay I would not close it. Once you close it I don't believe that you can reopen it and try to get your money afterwards. At least I was not able to when a similar thing happend to me.

Keep it open until everything is said and done.
