The buyer doesn't pay and I file to get my fvf fee back. Meanwhile this is a seasonal item and don't want to hold it for another year. Can I go ahead and relist it? What if the jerk decides to pay after 20 days and I have already sold it?

Relist now. Don't worry about the guy paying. If you haven't sold it yet, then sell it to this guy. If you did sell it, refund this guys money and move on.

they get 14 days to pay after that it is fair game to relist. I just refunded a guy that waited a month to pay...i have too much inventory and devote too much time on these listing to waste my time on someone that bids without having the money to back that bid.

I believe you can relist after 7 days if you have it in your TOS. Isn't there the option that you no longer wish to wait for payment? I don't know how that will effect you FVF refund but it may be worth it to lose that amount to get it sold. Doesn't seem fair but welcome to the world of ebay!!
