Why does this seller get away w/choice listings?

For almost two months I have turned this seller in for choice listings. They give choice of sizes which is NOT ebay legal. They even have subtitles stating "you choose...".
The offending listings are even cycling through again, so they don't seem to be getting pulled. They are an obvious violation of choice listings and they are getting away with it.

I was checking on prices of wedding dresses when my daughter wanted me to sell hers on eBay. I found that there were listings from China with as many sizes as you could want, and you just ordered the size you needed. I reported it, but of course, nothing was done. They were selling brand new wedding dresses for $19.99! You could choose size, color and fabric.

Amber, I too have searched gowns. They also are doing fee avoidance by the shipping fees. Thus the low starting price. (I ship tons international and those ship rates are inflated)

I still don't understand why almost two months of reporting the same listings they get away with it. Color choice is allowed. Size choice is not!

My fees would be reduced by easily 2/3 a month if I went the choice route they are getting away with. With almost 5000's listings that is significant (but would be ludicrous to try and keep up with what sold!)

I'm fed up, can you tell?

Question: do you think it is because it is the same id reporting them that no action is taken?

Why should "color" choice be allowed if "size" isn't?

Wouldn't "choice" be just that - "choice?"

I've seen many sellers who will place multiple things in one listing - and then say -- "eMail me to determine availability" and they relist the same ad repeatedly.

I don't think they care about "choice" reports as much as some of the other offenses.

But - as you said - the first time you did it, they'd pull all of your listings and make you sit in the corner for a month.

$9.99 in shipping is excessive? That's a stretch at best.

I think the fee avoidance was referring to wedding gowns.

I've been seeing more and more choice listings lately.

ebay doesn't have an option to report that type of aution, which may be why some sellers are getting away with it.

They most certainly do have it listed as a violation and it's easy to report it -- just doesn't get any attention when you do.

It's really unfair to sellers who play by the rules and spend much more listing each and every size/color combination. OTOH, it's a stupid greed rule that eBay made up strictly for their own benefit. It makes buying and listing on eBay a cumbersome experience.

UPDATE
Talked to my ebay rep in regards to this and she concurred, size choice is not ebay legal. Well, she reported back that ebay is reviewing that policy with a change in the works so they have not been pulling those illegal listings.

I requested to be updated as soon they new what their new policy will be.

If they change the policy,I would like to know. Are they saying meanwhile it is all right to"choice size"?

The way it was explained to me was they weren't taking a stance on it based upon the fact that with the change in the works, they didn't want to slap their hand when shortly it will/may be okay.

I will post as soon as I know. Probably will find out about it here first however!
