I don't sell much so am not sure about how to proceed.

Sent an item to buyer, asked for a physical address which was provided in an email. I mailed using our UPS account. Buyer's confirmed address is a PO Box. Buyer says item has not been received and opened a paypal dispute. I have tracking # showing it was delivered to his house.

Since I didn't mail to confirmed paypal address but did get a physical address from the buyer, will I have any recourse?

Nope. Haven't had the experience yet, but I believe that you're only covered if you ship to the specific address PayPal has confirmed.

You can always let them know that if they pursue the claim through PayPal you'll contact their local police to investigate the obvious theft of the item. They can't have the item and the money. The police can explain it better, but it might possibly be theft by deception or fraud - or a combination.

Just make it clear that you're going to provide the delivery confirmation from UPS to the (insert the name of the jurisdiction) police for their investigation.

Just out of curiosity, how much was the item we're talking about?

Yer tap-dancing on quick-sand, as, from reading between the lines, yer actually saying the following:

1) Buyer's CONFIRMED ADDRESS is a PO BOX...

2) I ship via UPS...

3) UPS does NOT deliver to PO boxes...

4) Thus, I shipped to buyer's STREET ADDRESS, which is obviously NOT the CONFIRMED ADDRESS...

Are you asking if yer covered under PayPal's SELLER'S PROTECTION POLICY?

The answer is "NO" because although you can prove delivery to the buyer's STREET ADDRESS, you did NOT ship to the buyer's CONFIRMED ADDRESS...

I used to get these all the time, since many folks have their credit card statements mailed to a PO box, and, thus their CONFIRMED ADDRESS is WORTHLESS for UPS shipping...

For small amounts, I would do it, but once it got over about $50-$75 (my comfort level), I would refund & point out to them that my listings clearly state that shipping was restricted to CONTINENTAL (lower 48) USA STREET ADDRESSES ONLY...

Amount in question is $37.82.

I do have copies of the email from me to the buyer asking for a street address and the buyer's email to me providing a street address.

I'm wondering if paypal will even look at the emails if I forward them or whether they will simply take the position that I did not mail to the confirmed PO Box and they don't care whether the buyer gave me a street address.

Stop worrying about it and send a very short and to-the-point e-mail (cc yourself) and explain that you will be contacting their police department and request that they cooperate with them in the investigation.

Something like:

Hello (Mr./Mrs. Buyer),

I've been notified by PayPal that you have said the (item) did not arrive. We shipped it via UPS as we had agreed and UPS has confirmed that it was delivered to you on (date/time).

I would ask you please to check with anyone who might have accepted it at your home. They might not have told you it arrived and I need to confirm that before I contact the police department in (insert buyer's town) to report it missing. I'll provide the UPS details and they'll probably want to talk with you as part of their investigation.

I do apologize for this inconvenience and appreciate your understanding.

I would try what Family states. You have nothing to lose at this point.

As anyone who has a merchant account would tell you,only part of your address is confirmed.
Email me at [email protected] and give me both his PO box address and his physical address.
Also UPS tracking results
