We had an international customer file a Pay Pal complaint for an item not received.
We responded to the complaint showing the receipt and copy of customs form and # but went ahead
and sent a second package via USPS Express Mail with signature and delivery confirmation and we sent the new tracking # to Pay Pal. Well, about a week later Pay Pal rules in favor of the buyer even though the tracking # said the package was in the buyers country pending delivery. The package was delivered just a few hours after Pay Pal ruled in favor of the buyer. We filed an appeal and today (13 days after filing the appeal) Pay Pal said they can't help us and that we have to contact the buyer and try and get them to pay.
We contacted the buyer and they said they received the package and even sent them a Pay Pal invoice over 10 days ago but they haven't paid and it doesn't look like they are going to. The item sold for around $170 and the buyer was from Italy. Pay Pal sure can take funds out of a sellers account with no problem but why can't they take the funds away from he buyer? The buyer has a feedback rating over 100 and also has items for sale.

How would you handle this?

I would no longer accept PayPal for anyplace other than US, Canada, and UK.

I know that's no help for you now, but it has been repeated here numerous times. In anything other than the 3 countries named, you're pretty much depending on the honesty of the buyer. Most buyers are honest, but it doesn't take many dishonest ones to ruin your day.

We post eBay and direct purchase items to Italy (from NZ) around 4 - 10 times a year without problem. No payment problems or reversals as we get paid direct into our EU bank account. If an item goes missing or is delayed, we are happy to cooperate in tracing it through the post office.

PayPal isn't really suited to international transactions as it offers sellers few pros and too many cons (including customers)...

try resubmit all the information again to Paypal,including the email from your buyer which said they have received the item.
Alternatives to Paypal would be moneygram and wiretransfer.
Or CASH

How many times has Ralphie warned that if ya accept PayPal internationally (except for CA & the UK) you RISK losing da moola because there is NO (repeat: NO) seller protection EXCEPT for shipments to CONFIRMED ADDRESSES within the US or CA or UK...

And everytime we say this, many come on extolling the virtues of accepting PayPal internationally, and how they've NEVER had a problem...

And you may go for YEARS without ANY problems whatsoever, but when the proverbial kaka-poopoo hits the proverbial fan, about ALL you can do is write it off as a business expense, and a lesson learned...

IOW: if you accept international PayPal payments, you stand a GREATER risk of losing both the product & yer moola than if you do NOT accept international payments: it all boils down to what is yer RISK TOLERANCE LEVEL?

But don't blame PayPal! Their rules are very clear and easy to understand & follow...

The buyer has a feedback rating over 100 and also has items for sale.

How about bidding on a few of this person's items. Then pay them with PayPal and then file a chargeback on them. Seems like turn around is fair play in this situation.

well,forget resubmitting any information to Paypal,Tom is right,you get no seller protection shipping to Italy.

If they don't send you your money then it's payback time & well deserved.
Do as stone & hwa suggest.

Your lucky you have the oppourtunity, most don't.

Italy post is notoriously unreliable. I guess one lesson learned is don't reship until Paypal resolves the dispute. I don't think the retaliation suggestions will work since you have a confirmed address.

Paypal can't reverse a payment more than once so don't waste your time with that.
I had a dispute ruled in my favorite and the money returned. Then the seller sent them (they do not accept emails as proof of anything) a print out from the post office and they reversed their decision but they couldn't reverse the funds again (per paypal).
They "requested" that I resend the funds. I wasn't inclined to do that as I never received the item. They said it would be a black mark on my record if I didn't.
Finally I spoke with a supervisor and after a long conversation he reviewed my paypal history and due to my great record they paid the seller but not from my account. It was taken from paypal's funds.
If you have a good record and get the right supervisor (only speak to a supervisor) they MAY give your money back. Fax them all your information first. It's worth a try.

It wont work,Italy is not covered by Paypal seller protection.

Seller protection has nothing to do with what I suggested.
The point is that paypal can do whatever they want to do and in my case they helped me.

Your case is more of Paypal mending its own fence,it has little to do with your great record.
Paypal reversed the payment from your seller account to you too soon and then the seller came through with proof of delivery.
