Perfumebay.com has finally caved into ebays' demands that they change their name. they are now being called Beauty Encounter. Ebay took them to court because they used "bay" in their name and ebay says they have a copyright on the "bay" in a name.

So - wonder what happens to Pelican Bay or Chesapeake Bay or Bombay????

The Bombay Company is out of business as of January 21, 2008.

Edited to add: if you have one of their gift cards you must file a claim before March 1st.

Bombay established its name in 1990. ebay would have no valid claim to the bay name when applied to Bombay because ebay name was founded after 1990.

Half Moon Bay in California is changing it's name to Half Moon Britches to avoid a lawsuit. I guess a lot of plumbers live there...or something.

I think "Bombay" predates 1990 by a couple centuries. Mumbai, though....

But they didn't call themselves Bombay Perfume, Hudson Bay Perfume, Perfumes of Chesapeake Bay, etc. They run an etailing business with "Bay" worked into it, so that it does look apparent that they were trying to ride eBay's coattails, and apparently this is what the court saw.

Businesses such as Hudson Bay blankets or owners of houses with bay windows have nothing to worry about.
