Did you see the uber angst baseball eBay mom on People's Court today? At the last moment, she bought tickets for a soon-to-be closed Yankee stadium game as a birthday gift for her son. She bought the tickets on July 27 (Sunday) - the game was July 29th (Tuesday). She lived several states away, so gave her mother's address in NY as the ship to address. The evil seller went to Staples on July 27th to send the tickets, knowing they had Sunday pick-up, and sent it overnight.

Unfortunately, Staples did not ship the tickets in time and birthday boy was scarred for life by the missed game.

What did the evil seller do? Refunded her payment in full on July 29th. What did baseball Mom do? Publish a slew of defamatory remarks that the seller never shipped item and sued for her cost of transporting her family for the trip to NYC and pain and suffering.

Evil seller counter-sued for libel. The judge found in favor of eBay seller since he had already refunded the money but denied his counter-suit, saying that his filing of a mutual ending of transaction with eBay was untrue and somehow defamatory to the buyer.

Hmmm. She bought the tickets at the (1) last minute and on a (2) Sunday to boot. She didn't have them sent to her (3) son. Sure, the surprise factor would have been spoiled, but jeez.

And. . . the Staples part of the equation was botched. She overreacted. Instead of learning from her mistake(s), she blamed someone else.
